This is the problem with used phones unfortunately. Some people even sell their phones and then claim them on insurance way later on.

Well yeah but....2000+ good feedbacks. Seller only seems to deal with phones so looks legit enough. He's going to try and contact the previous owner and see if they know what's up. I won't hold my breath.

In that case, the person you bought it off should give you a refund (or even a partial refund). Then he can chase up the person he bought it off and so on. That's what I'd be doing as an honest seller, but I realise most traders wouldn't do this, especially after 6 months.

Edit: Just saw the post above mine. The fact that he seems like a commercial operator should strengthen your case. Is he listed as "in trade"?

Yep, I've got hold of him and waiting to see if he has any luck with the original seller. A refund would be ideal (especially since I drunkenly dropped it on the train one night and smashed the screen)

If they are in trade just request a refund and ask them how to arrange collection of it as it's not fit for purpose.

When in trade you have to take the loss on sales that go bad in exchange for the profit on all the ones that go good. If they cry about losing money it's not your problem because you saw that in trade notification on Trademe.

It's about now that you should be made aware that the in trade message is a tick box for the seller and many use it when they have no understanding of their obligations for an in trade seller so you may have to educate them on those.

Totally this.

 

 

 

 

 

Get him on the CGA with the "not fit for purpose" as you can no longer make calls / text etc.  Let him know that it has been blacklisted so it could be listed as stolen.

 

Did you get the screen replaced or is it still smashed?

 Just note however that he has the option of "putting it right" or refunding so you might need to agree to something with him.
