Get him on the CGA with the "not fit for purpose" as you can no longer make calls / text etc. Let him know that it has been blacklisted so it could be listed as stolen.
Did you get the screen replaced or is it still smashed?
Still smashed
tripp:
Just note however that he has the option of "putting it right" or refunding so you might need to agree to something with him.
What kind of phone are we talking about?
Samsung Galaxy S5
If it was me.
I would work with him asking for either a refund or a replacement device. I am not to sure about the smashed screen but if the phone is blocked in NZ the only place he can resell it would be overseas where it is not blocked.
You will need to tell him about the screen and go from there.
How much did you pay for the device (if you don't mind me asking)?

Enough to chase this up with the seller though. That's $400 you could be putting towards another phone.

Around $400. Not enough to warrant getting the screen repaired
I would be asking for $300 - $350 refund as you did damage the screen. Other might feel a bit different as the problem you have has nothing to do with the hardware.
The trader could take the blocked phone back, swap the smashed screen onto another device, and give you that one.
Opinions are my own and not the views of my employer.

Bung: Some assumptions being made. Does it take over 6 months to process a request to block a stolen phone?
No but people can wait and report it stolen, or get one put on the account to pay off and then sell it and stop paying their bill. I know spark will block phones that are on an account if the account is not paid, maybe vodafone does this as well.
In my time with Vodafone a handset wasn't blocked because of non payment. However, times are a changing!

I suspect this may be what's happened
Update: Just put my SIM card in and working again
Who did what...I have no idea.

Bung: This TCF page for checking imei blacklisted numbers
http://www.tcf.org.nz/content/cfa46b54-509c-44aa-91da-3bfe14d20f8f.html
suggests phones can be blacklisted up to 30 days after being stolen or 90 after fraudulent activity.
Makes working for 6 months appear odd.
Strangely it still says I'm blacklisted. Maybe it takes some time to be updated?
Samsung Korea SM-G900F
This IMEI number is currently on the blacklist
You could root and change IMEI if you were that way inclined.
