I need some advise, my mother placed an order on TheMarket on the 1st June for a bread maker, she has already paid for it and it has been in the "Confirmed" status since the 1st, she has tried reaching out via their customer service and emailing them asking for an update on it and expressed her "unhappiness" that she is still waiting , but nothing is coming of it, the Bread marker was to be supplied by Noel Leeming, is there anything else she can do? can she not just go to Noel Leeming and ask for one and move on?

Linux:

Charge back on the credit card

She wants the breadmaker, it's $100 more now if she buys it now. She doesn't want a refund she wants the breadmaker.

What bread maker is it? If it isn't the Panasonic SD2501 I would just take the refund and buy the Panasonic. I'm appalled at the prices though, $400?!? It's like $200AUD!

I know since Covid there has been a shortage of breadmakers with everyone pretty much sold out. I would just get a refund as you could be waiting for a while of you are waiting on a particular model.

She paid around $155 for it, now it's $259.99, I'm starting to think this whole hold up is just so she cancels the order and they don't have to sell it cheaper to her.

The pickup location she ordered it from shows 4 in stock on Noel's website.

Your "problem" (not that you or your mother are responsible for it) is that TheMarket is owned by The Warehouse Group and you are also dealing with a TWG-owned brand. There have been numerous cases here and reported in the media where TWG has behaved very badly towards consumers and instances where TWG owned companies have been held to have breached the Fair Trading Act. To be blunt, they are close to the territory of warranting the description of "scum". Your mother can try directly contacting Noel Leeming's helpline by phone and see where that gets her to.

Good luck.

NL now being investigated by the ComCom for this kind of behaviour:

For all their talk about social responsibility etc, TWG companies are truly worse than scum at times.
