Hi, I don't mean to open any old wounds as I believe a recent discussion here went out of control and unfortunately I do not have access to this information any more.

I am currently about to escalate a concern with Noel Leeming's Price Promise to the Commerce Commission, and would like to hear from anyone who has had any issues themselves with either Noel Leeming or sister stores Bond and Bond when it comes to their widely promoted "Price Promise".

I do note that in September 2006, another Geekzone user raised concerns which were forwarded to the Commerce Commission as outlined in this thread:

So please let me know if you have any personal experiences or additional knowledge such that I may be able to forward as much information as possible to the Com Com to aid them in investigations.

If I remember correctly, he bought the wrong product and tried to return it to Noel Leeming after the 7 day guarantee, citing a promotional price at K-Mart.

From what I have been able to find out, someone tried to return a product in resellable condition and exchange it for another product, and they refused to price match a competitor's discount on that product he wanted.

I was not privy to the discussion but Noel Leeming clearly has 2 policies that seem to have been breached (on the face of it):

1. There is a 28 day right of exchange for products returned in resellable condition
2. Price Promise to match competitor's promotions.

I am only interested in the Price Promise as I have concerns that this may not be being honoured and therefore in breach of the Fair Trading Act.

I would be very interested to hear from anyone who has had problems with the Price Promise at either Noel Leeming or Bond and Bond. As I said, I am happy to be contacted privately if you do not wish to put the details out publicly.

Oh, I thought you also had a problem with it. I was involved in that discussion and it was complicated by the fact that there were two parts to the problem and originally the explanation wasn't clear. In Noel Leeming's defense, they were happy to exchange the product as I recall, they just weren't prepared to use the "store credit" from the exchange in conjunction with the price promise. Not sure if that's fair or not, especially because the way they went about it was to try and use the price promise exlcusions to do it. Perhaps if they'd said price promise is not applicable to exchanges etc that would be a legitimate excuse, but to try and say the product at Kmart was on manufacturers clearance is not right.

Anyway, I wanted to test out the theory by going to Noel Leeming and seeing if they would price match the Kmart price (by all accounts a very good price). In the end I couldn't find a Noel Leeming that had it in stock, so I ended up getting it from Kmart.

P.S. Is this what we're talking about, or have I gone OT? I'll be following this thread with interest. I wonder how many people have had success/issues with the price promise policy. I've never really seen the point of these price promise things. If they don't honour it, what does it matter? Just get it from the other place. The only reason not to is if you can't (i.e. too far, no stock, only NL store credit - no cash to take to Kmart) and the policy usually as exclusions for these types of things, doesn't it?

Where it "matters" is that this Price Promise would be in breach of NZ trading laws if they were promoting it to draw people into stores ("bait") and then not honouring this when customers turned up in store.

The Advertising Standards Authority ruled against Noel Leeming in mid-2008 when they refused to price match a vacuum cleaner advertised for a lower price at another store. But NL in their defence said this was a problem at the store level, rather than a systemic issue through their stores.

And in 2006 there was the case as highlighted in the first post of the thread.

And of course the recent issue with the user that has now been removed from here.

They cannot be allowed to continue promoting this Price Promise if they are not sticking to the advertised terms and conditions.

Granted, all I meant was if it happened to me, I'd just go and get it from the other place and never go back to Noel Leeming. That seems like a good enough incentive for them to honour it (at a compnay-wide level, if not at each store).

It will be interesting to read developments.
