IANAL and I can tell you aren't either.
If you read the news you'll know that judges don't use their whims as a basis for their judgements. They are often tightly limited in what they can do. It might shock you to know that they are limited by a thing called the law.
Yes, the law says what name suppression can be used for. Not talk back radio. Carefully considered law.

So this fella meets the criteria and qualifies for name suppression. The only interesting thing is what those criteria are.





Most of the posters in this thread are just like chimpanzees on MDMA, full of feelings of bonhomie, joy, and optimism. Fred99 8/4/21

My guess is that he has been on trial for a second offence and his name was suppressed so that the second case wasn't influenced by the first.

 

Now that his second case is over? - name suppression is being lifted. 

 

Or would have been except he is planning to appeal. As he is doing all this on legal aid, he will milk this to the last.

Mr x gets charged for say selling dope name is out there for all to see because he is average joe blow

 

Mr y gets caught for selling dope and is a high profile person who has loads of $$ - Name suppression is granted as it may hurt them , Boo friken hoo 

 

I am just sick of the double standards that are in our justice system.

"British backpacker Grace Millane's murderer named as Jesse Kempson, sexual violence trials revealed"

 

 

The man who murdered British backpacker Grace Millane can now legally be named in New Zealand.

 

He is Jesse Shane Kempson.

 

And it can now be revealed Kempson faced two further trials for violent sexual offending against two other women.

 

He has already been convicted and sentenced for those crimes against both women after judge-alone High Court trials were held in October and November this year under a shroud of secrecy.

 

His additional prison sentences will be served at the same time, alongside his life term for murdering Millane, which includes a non-parole period of 17 years.

 

Kempson will be 45 years old when he is first eligible for release in 2037.

There is no double standard - it's coded into the law. Anyone who meets the criteria can apply for name suppression.

 

What is a factor is having the money to take on a vigorous defence of your case but that applies to all use of the law not just when name suppression is involved.

Well there you go, now it's all out and as suspected it was to do with other pending cases. I'm glad he is seeing justice.

That's stupid. If his additional sentences are served at the same time, he's not actually being punished for the other crimes at all.

 

Given he's a serial offender, and not likely to be improved by 17 years in prison, I'd much prefer that they add to the end of his sentence so he doesn't come out until he's physically too weak to attack women.

Glad the Courts have not stood by and let a meritless appeal with little chance of success allow suppression to be prolonged by the shutdown.

And, referring back to the thread title, assuming Mrs Smith's cat doesn't get stuck up a tree or something else similarly newsworthy happens in NZ today, tonight's TV One news is guaranteed to contain 20 minutes of regurgitated footage from last year.

Doesn't matter how many of these offenses he is convicted of  they will all be served concurrently (seems to be the NZ way).  They need to be consecutive that way be may be away for real life.
