Incidentally, I just submitted a claim to AMI. An internal leaking pipe caused water damage.

Leak is fixed , I thought the cost would be covered. But, AMI now tell me they have a 'special' clause limiting damage from internal leaks to a very measly 1500.

While I don't think our repair costs will be much more that that (just a bit of repainting and plastering), I am surprised. I get insurance to protect against this very kind of thing. A leaking pipe could potentially wipe out ones life savings, so , is this not what insurance is for?

I get the whole actuarial maths etc, but, I don't mind paying a little more to cover this stuff.

Anyway, I have been with AMI for 10 years or so, they've been good on payouts (one car, one house, one iphone claim) but might be time to do a review.

Do you have that black 70's/80's/90's plastic piping? If so that will be why it has been limited. You will need to get your house replumbed if that is the case, because that stuff will continue to leak.

The contract is with whomever PAID for the work. If the Insurance company gave a list of recommendations or offered you your own, doesn't matter, the liability falls back onto the Insurance company, however either way the only person who 100% shouldn't need to pay is the OP's mother.

When push comes to shove the Insurance WILL fold here if you handle this properly, and they will likely just send plumber B to fix Plumber A's muckup.

The leak was fixed 9 months ago. The second plumber just tighten the loose pipe to fix the leak; it was just that simple. We had tape the video before it was fixed to show how poorly it was initially install.

AMI is a division of IAG, which have... a bit of a reputation in Australia for stuff like this. They'll very rarely stump up and do the right thing straight off the bat, but the word "ombudsman" normally gets them moving.

Not quite sure, it is maybe a little unclear, the OP said this...

"AMI internal complaint department told me "I always has a choice" to choose the plumbler so is "All my fault"."

Anyway, it doesn't matter, I would name both the plumber and AMI on the claim to cover all bases.

Unless you are a qualified lawyer I would not necessarily take your word. You could be right, but this is slightly more complicated situation. I do agree the OP should not have to pay 1 cent.

I'm amazed the plumbers indemnity did not cover the damage. What is the point of asking tradespeople for proof of indemnity if their cover does not pay out in cases like this?

After AMI were bailed out due to the CHCH earthquakes. They were sold to IAG. which is the company that also owns State, NZI and Lantern insurance, and underwrite ASB bank insurance.

So AMI today is completely different to AMI 15 years ago.

Let me put it this way. Not sure what line of work you are in, but.. Let's say you are a sparky.. I call you and ask you to do something for my mother, you do it, but damage is caused, and my mother asks YOU to rectify it, gives you instructions, pretty sure you are going to come back to ME right? Same as if she asked you to do additional work outside the scope

of what was quoted, and agreed between you and I?

Same applies in Law. I am not a Lawyer, but I am very confident about this.

My mum's bath was accidentally damaged last year and we put in an insurance claim to AMI. AMI organise a plumber to replace the bath but after about a month we found out water was slowly leaking onto the bedroom next to our bathroom that caused mould onto the carpet and wall.

We complained to AMI and they insist my mum need to pay yet another access while they are investing the case. They dragged on the case for another 9 months by telling my mum to wait and until now they try to settle the case by only compensate $1000 cash to us for a repairing job which could easily cost us over $3000.

That would be normal, it is a new claim, not part of the bath issue. Even if it might be because of what the plumber did or not, it is still a new claim.

I can't see how a bit of mould will cost $300 or more......trying to get them t replace the lot are you?

I have had numerous claims with AMI, always been good, no hassles, no arguments.

One was car....insure value $3000, repair cost $2800. We thought they'd write it off, but no, they went ahead with the fix (our preference).
