Add yourself to the list if It's who I'm thinking of.

Let me guess, they also run a photography business and astronomy open days on their back lawn?

You may be correct, yes.

I would notify the commerce commission about this conduct as well.

And get a letter.....

"At this stage we will not take any action.  We will send a letter notifying xxxxxxx about their responsibilities under the xxxxxxx act."

Has anyone here actually had the commerce commission actually do anything?

Could this be considered mail fraud?  That is a crime in the USA (using my legal expertise gained watching US TV ).

Not sure about New Zealand.

You do sometimes see the police chasing trade me fraudsters who sell goods but do not ship.

Both Police and CC and Disputes Tribunal have been approached by others about similar cases from same retailer. Police didn't have enough to go on despite multiple cases. Never appeared to defend (usually out of town courts), so minimal wrist slap applied and court order to refund issued.

Most recent case before this was as little as 4 days ago, and a couple of weeks.

If it has now been established that this retailer has a history of doing this, is the reluctance to name them here still justified?

No idea why people here have cold feet when it comes to naming these outfits. Sure if you don't want to deface them to try and keep people happy until the last minute or what but it is frustrating because a lot of people here buy products in that category and it would suck to have it happen to someone else.

I'd suggest he is doing the right thing until it's proven they won't sort his gear. There is plenty of time for it when it's resolved one way or another. Naming and shaming can easily backfire.

Yeah totally agree with that. It seems that this one isn't negligence rather fraud but then again I'm driving the bus from the back seat.
Cheers

From my perspective, although I know of it, everything about it is 3rd hand from FB groups mentioning similar stories narrowed down to a particular 'retailer' so I'm keeping my nose clean

But it appears the crowd in question appear as a reseller, but drop ship and often has importation issues that blow out and are covered up.

Anything in common with the Telescope company on Fair Go tonight?

People often mistake me for an adult because of my age.

Interesting tangled web he's spun. If it's the same chap, of course :-)
