What consent checker did you use? I tried the Auckland one with a 1.2m deck and while I was entering data it told me that with a 1m balustrade I'd have a 2.2m deck at the end it said no building consent required as it was under 1.5m as per Schedule 1 of Building Act. I'm puzzled about your dining area comment. It didn't arise in the Ak checker and I don't see the relevance.

Was the trellis barrier in the original plans? The current barrier requirement would want more than 1 bolt for the upright posts. In other words would it collapse if a row of you largest friends were standing on the.seat looking over the barrier.

I used the one in the link provided earlier. See below. From what I understand based on the photo, it is because its next to the sliding door in the dining area.

Ah! Auckland Unitary Plan. It's flagging the need for a Resource Consent not Building Consent. It didn't come up for my test as I used a stand alone house as an example and what you see out the windows isn't controlled.

It is a stand-alone house with the deck right outside the sliding doors by the dining area.

It's possible that the lattice work does not meet current building code, in terms of climb proof barrier.  Usually need solid panels or vertical bars only at a minimum spacing.

 

Ramp looks steeper than code.

 

Can you contact the current owner? Talk to duty building control officer at council. 

 

You could apply for code compliance certificate, if you have the owners name and address, property details, eg PN & legal description, building consent number. However the final inspection needs to be arranged, and likely an inspection cost to pay. 

 

CCC is building consent, not related to resource consent.

Someone suggested the same thing but I think there is not enough time to get this done as the auction is next week. I was also told that the owner needs it sold with no conditions as they already have a pending purchase of another property. At this stage I feel that the best course of action is to walk away and move on.
