I am not saying I agree with large media companies using third party stock images/footage without licensing or credits (which I am not even sure is the case here). Just trying to understand if this is a case of two different values for the same thing?

Oh it absolutely is. It's safe to say that the majority of users here will have some form of copyrighted music, video, or software on their PC's that they dont legitimately have a license for. The vast majority of people have no or limited objections to breaching copyright for personal use. Yet most people (myself included) also expect a business to not indulge in those same practises.

Is it somewhat hypocritical? Perhaps.

Lias: I googled for "Ice Cream Quenelles" after getting the answer wrong (looks like a bloody scoop to me!)

I would say a scoop is more spherical. Quenelles are oval.

When the earthquake happened, apparently a few images in the GPForums thread about it got nicked by various media outlets (stuff being one of them i think). Makes sense as they scrambled to get pics asap before others.

I've seen at least one my Desert Road pics on Picasa used on a web site by a Kiwi travel company. The cloud in the pic was THE cloud in my pic. The whole pic was mine.

Upset? No...I thought it was really cool. Someone liked my pic! LOL!

Yeah...I noticed most of the media asking people to send in their own pics and any received that way may well have replaced the "stolen" pics.....though I consider any pic I post on the Net to be fair game for copying....or I shouldn't have posted it.

I get lots of good free stuff off the Net.....and I like to think I give some back, too.

There is actually an stock image company, I forgot the name of it, that does searches of their images on websites, and looks for businesses that are using their images without paying for them, and then sends them huge bills for a license to use it. If a website was using my image without my permission, I certainly wouldn't be happy. If people want photos for their website they should get permission from the author or buy it.

But hold on, are you saying anything you post on the web automatically has some sort of magic protection? If you post it, with no warning about borrowing it.....you can claim a breach?

Now you are just being silly.

You understand exactly what I meant. If you publish something by any means, even without explicit copyright claims, the content it's still yours and you retain rights over it.

What I'm getting at is, lets say for the sake of argument that Stuff simply surfed the web (yes yes personification at it's finest), found a pic they liked, cropped it, and posted it.

Let's also say the original person to post that pic simply posted it. No thought to licensing (not even sure how you'd do that), or claiming any 'copyright'.

Has Stuff committed any offence? Is the burden on the original owner to be aware of the use, and to request it to stop, or is Stuff using the photo enough for some slight to have occurred?

Yes. By publishing the work, the author automatically claimed copyright. It may not have attached licence terms to it, by any other company/person wanting to use it should contact the owner to arrange for appropriate payment or licence.

Of course it is really hard to find your work around the world. The company using the work in a commercial way should be ethical and contact the owner.

For an example of the absurdity, see report of a stolen picture used for commercial/endorsement purposes.

Technically, freitasm didn't breach copyright when he quoted you, because he attributed source ;) Regardless, he would be covered by fair dealing too.
