As it is now a standard affordable plan in AU, which is suffering from the same distance from useful content that NZ does, yes it is fair usage.

What isp there offer's that??

iinet, iprimus and some other one launched them that I recall. They are pretty poor performing from what I have been told but make slingshot look like dialup in comparison.

Well, as long as you're willing to pay for it, NZ isn't too bad for data sucking either. All we have here is a lack of competition.

nate: If I remember the thread the OP mentioned, the issue was the sheer volume of SMS made it near impossible for it to be legitimate user.  I don't think it's unfair for Telecom (or anyone) to kick a user off if they are using a modem/automated device to send SMS en masse.

That was me, and it was my friend (and it was single person to person texts) but I totally agree, automated or spamming texts is not fair use and is just asking for kicking off the plan. Same as an unlimited broadband plan downloading at full speed 24/7, thats not normal use.

(as previously said to nate's comment)
ArcticSilver:I agree if they are using a automated service. I don't if they are just using the texts (as unbelievable as it may be).

That statement sums up 'unlimited' plans to me.

You pay for the larger BB plan, no issues.
You abuse an unlimited plan with hundreds of Gb's of data with them, agreed.

How do you "abuse" unlimited though?

So unlimited is really a 400GB cap? Why not just say 400GB's with shaping?

I can download 30 albums to my seedbox in the time it takes to get one song down from it to home. Even unlimited at the speeds I get would not be enough till the speed is sorted.

I don't know how accurate this is (you can't trust stats!) but apparently a large proportion of torrents in NZ are from people downloading TV shows right after they've screened in the US, and months before they're available on TV here. If only the local TV networks took a more proactive approach, the "need" to torrent could be reduced.

Come on... the situation in AU allowing these plans is massively different to the situation in NZ. And you can BET YOUR LIFE that if every user (or even a small fraction) tried to actually use 1TB every month then the ISPs would suddenly find they had to run at a loss or compromise the user experience.

Cheers - N
