I read an interesting comment today (apologies if this has been covered but I am not about to go back through the last 27 pages of this thread)

...the reason behind all this is that Dotcom was about to launch a music distribution network enabling recording artists to sell directly to the public with a minimal loss in commission, thereby cutting out all the major studios (and all the gazillion $$$ they make). In other words all this kaffufle has nothing to do with copyright.

I sorta don't agree (intentionally sounding unsure)

I agree that these companies make more than they should and pay the creators less than they should, and have too much control as in the ability to "allow" air play (which is crucial).

To cut them out will be a BIG issue with getting new songs on the radio. While I can see these companies playing hardball, I also feel that there is a big legal push for pirating, more so since the S92 here and elsewhere hasnt really done anything, and far easier to take down 20 websites than 20 million downloaders. Netherlands are heading that way too. BUT having said all that, something needs to happen to make digital obtainability across the board.

I should find it easy and cheaper to buy a book, game, song, movie, TV ep, software, online. This actually exists, but the digital range is much less than the physical range.

What needs to happen for Kim to be removed from New Zealand now? Is there a hearing to decide the validity of the extradition application or is that guaranteed?

I've heard that too, as well as it being payback for the SOPA/PIPA protests the day before but I don't agree. The FBI have been working on this for 2 years, according to them, and you couldn't even get the indictment written in a few days, let alone get it through a Grand Jury and organise the raid.

I doubt the labels will be unhappy to see Megabox not happen as planned, but I don't think they engineered this to stop it.

Yep, there will be a hearing, and that may take months, if not years.

IANAL...but Yes there needs to be a hearing, but as I understand it our extradition treaty with the USA is quite limited with the nature of offences covered. There is nothing specifically that covers the offending he has been alleged to have masterminded, so the first defence argument will be that the application for extradition has no legal basis in NZ.

Call me cynical but I sense a fair but of 'politiking' in this one.

I did read the other day after the failed appeal that something is happening on 22 Feb, that may be the extradition hearing?

I don't think you are being cynical, it's right in front of your face.
Kim dot com was giving artists 90% ! thats a huge stake.
That's why he went down, although that's just my opinion.
Do we really want police like this, this is New Zealand ? This special squad of officers were supposedly the highest trained members of the force. If this elite force are incapable of reasonable professionalism what hope is there for Mr Plod and his Taser ? The police rely on the support of the public and I'd like to think that we would all stand behind our local cop. But when we hear this sort of rubbish....thats a real problem for NZ.

Looks like most of the allegations in the indictment are just allegations.

Turns out dotcoms 'stolen passport' was just expired , the gun was bought with a licence, this list goes on. Also some interesting numbers , of the 4.5 billion files on his servers less than 9 million could have infringed "copyright". I wonder if the director of 'youtube' will get the hellicopter treatment also, pfft.

The last article is the most disturbing, the rambo style commando action carried on inside the house, his little kids ordered at gunpoint and removed from their mother ( pregnant) who pleaded for an ambulance and was told, "go and ring 111 and ask for one" till wayne Tempero, dotcoms bodyguard managed to find a cellphone as lines to the house were cut as part of the raid.

This is very very sad behavior.

Where are the facts stated that he gave 90% of all proceeds to the artists? Im surprised thats not splashed all over the news, a journo's paradise. If he gave 90% to the artists then all of the artists are in breach of contract. I hear what you are saying, and your reply is based that this is all 100% factual, but it doesnlt really add up to me.

I believe the 90% commission rate was something he was trying to put together, in other words he was working with the artists to cut out the middlemen. Contracts always have an out or can expire hence it was a work in progress. Just imagine if someone managed to do that. Cheap music for the players, good returns for the artists/creators, and no middlemen clipping their massive inflated ticket along the way...sweeeeet!

Its quite interesting if you search mega box and dotcom on google, the main stream media appear to have ignored this little gem. I'm sure reporters must have at least stumbled across this, but, well, I guess they have to put food on the table.

It hadn't properly launched yet but it did seem, in hindsight, that it could have been a genuine threat to the labels, given MU's huge userbase as potential customers/revenue generators via ads.

Um, that's actually how the system works. You allege crimes in an indictment to get the accused into court for a trial where you have to prove the allegations.

Not just in this case, but in every case.

Yep I understand that, but if I was to say things that are largely untrue about you, as an individual, that would be libelous. I guess that's different for companies and different when the FBI is pulling strings.

Look. I'm not saying Kimdotcom is an angel, we all know he must have known about copyright infringements happening on his servers.
But lets be reasonable the Police action and the motive behind the allegations are likely (IMHO) to be corrupt or in the least anti-competitive. It's a smokescreen, that's the real issue for me because when we ignore govt corruption to appease another more powerful country then we end up as corrupt as the players and frankly thats when people end up without rights.
I feel I need to stand up for this guy becuase he has been beaten up big time and I'm not sure, in fact I'm dead certain, that there are much bigger powers at play here.
