IIRC the search of phone also applies for the sin of talking/texting while driving, I remember something about officers having the power to check your ph records to verify said offence, could be totally off base there though

ronw: I suggest you use the time honoured National MP defense  - memory. John Banks could give a few pointers also. Its so hard to remember these numbers. Interested that in the Pitorius trial in South Africa he claimed he could not remember his unlock code and police seem to have just accepted this. As I understand it in a case like that Apple will unlock phone. Failing that there are ways that can bypass the unlock code surely any major police force would have access to such technology?

certainly not only a National MP's defense, maybe you meant politicians, I won't drag this thread anymore off topic by posting examples of other parties doing the same. Sad people use threads to grind their particular political axe and get meaningless ill informed quotes in.

KiwiNZ: Hmmmm, these threads. Why ask for legal advice on a tech forum?

What else would all the arm chair lawyers here do with all their spare time? ;)

This explination confuses me.
Why do they have your phone in the first place?
Why do they need to access it?
Who has it?
If the phone doesnt have a lock screen enabled, then why would they even need a password?
Are you 15?

sbiddle: All SMS messages in NZ are stored at the request of the NZ Police anyway. All that is required is a warrant to access them.
!

 No they are not.
Where did you get that from?

It's just most people leave all their txts etc on their phones.

Archiving of text messages etc was available to the Police with a warrant up until recently. The Telco's decided to stop the archives, I believe Vodafone was the first to do this.

Here is a crazy notion, lets give peace a chance.
