Its stupid that council is so focused on rules/regulations instead of just using some common sense. The building act allows them to do just that.
No, it is if the structure fails when there are children on it. eg not enough connectors, vs the weight of multiple children on it. Think about what happened with Cave Creek tragedy. The things is whether there is an exemption for tree houses or not, or whether there should be. Yes common sense should be followed, but that does need to be weighed up against whether it can be shown to be safe. That is why I do wonder why the council can't just assess it and check if it is safe? Although they probably would have to contract that out to someone else these days.

Cave creek was a structure open to the public and maintained by a Govt department, slightly different when public liability is concerned.
If you want to control safety on private property, how far are you willing to go? Swings? Lawnmowers? Play sets? Ladders? Backyard sport?

I would bet money that the neighbours complained and the council came out repeatedly until they were bound by law to do something about it.
Not sure about the tree and height but if the floor-area is small enough they can call it a 'temporary structure', might depend on region.
