If a phone has high features and a low price, then something has to give, in this case it seems it is build quality. Just like If I buy a $500 couch from the warehouse, I wouldn't expect it to last as long as a $1250 couch from Farmers.

What I'm saying, that taking into account the price of the phone compared to the market, I don't think a year is unreasonable.


I disagree. I would expect the $200 phone to last just as long as the $500 one. The materials on the $500 phone may be nicer so it might have fewer scratches etc, but in terms of actual operation I wouldn't expect a difference. What you're paying for with a more expensive phone is brand, design, features, speed, battery life, but I don't believe expensive phones last any longer than cheap ones. The warranty period is no indication whatsoever of the expected life on the item.

  Calmly explain the situation and be prepared to leave the store without resolution - of course only after taking down the managers name and his managers name.

Write to NL (or whichever store) - email or snail mail using registered post - get them to explain why they believe it is not covered.  Request a response within a specific period of time (be reasonable) otherwise you will take a lack of response as a refusal of their obligations.  Then be prepared to take them to tribunal for $30.

In honesty, speak and reason with the manager - at the end of the day, they don't want to argue either and most will understand and assist.  Best advise - be calm and factual.  As soon as either of you become emotional or aggressive it's time to walk away.




This. As someone who works in retail, I think the absolute worst thing you can do is get angry and agressive. You will find the nicer you are, the more you will get out of them.

As someone who used to work in retail, I found the customers who got the most out of the store were the loud and annoying ones.  The manager wants to get the sorted out as quickly as possible to avoid other customers seeing what is going on so he pretty much just gives in to their demands.

Quick update;

1) Dropped off the phone on Tuesday. Manager was accomodating and agreed to send off the phone to be assessed. Very different experience from NL Paraparaumu who basically just said it was out of warranty. Didnt even have to argue, the sales guy just went off and asked the manager who okayed it.
2) Got a call today from NL to say Vodafone would be replacing the phone with an 858 and they would call me when they've got it from Vodafone.

Good result and the wife is happy :)

Diasgree with this. Yes in some situations it will get results but I had a mate lose out on a full refund after he kicked up a fuss with the manager. After the manager finally agreed to refund him my mate muttered "its about bloody time" (or something to that affect) and the manager basically said forget it and retracted his offer.

So while some "volume" may be required to get what you are entitled to but you should always be respectful if someone is doing you a favour.
