I would not be surprised if the contract includes, or will include in its next revision, language saying that "it is the customer's responsibility to ensure that the bin is, on collection day, located in a position where it is clearly visible to the driver and readily accessible for collection by the vehicle" - the implication being it's your problem.

 

 

I’m sure you’re right and if that’s the case (and if their customers read the fine-print) their customer base is going to head south - because the alternative Council service doesn’t have this problem. We’ll certainly be changing.

The alternative services will also have this problem as Council's contract out their services to WM and others but run branded trucks.  This is all to do with Work Safe legislation and the upcoming prosecution of the GNS scientists now; previously companies would have been fined but no other issues... now Work Safe are starting to use the full ability of the Act including the ability to prosecute individuals within the company for failing to uphold their statutory duty of safe working practices.

Well, a bit of a bombshell. I just received the promised call-back from WM and had a long and amiable conversation with the Operations Manager - Residential.

 

He asked what was my issue and I related the stuff I set out above. He said that:

 

  • The advice I was given about H&S and drivers not being allowed to leave the cab is completely wrong.
  • Drivers are required to get out and grab the bin if it’s behind a parked car. (The only exception to this might be in the CBD where differing situations may arise).

Simple as that. I said "So to be clear, what I was told about H&S and drivers and cabs etc is not correct?" He said "No, definitely not correct". I asked why the SCR had told me and repeated the story about H&S and so on, and he said he no idea where they got that from. He gave me the impression that he was in despair with the CSRs and said they were going to have to ‘sort that out’.

 

The conversation was longer than this but this is the short story. I guess I can take his advice at face value - I’m certain he wasn’t BS’ing me. It does make you wonder if WM really know what they're doing - or if there's conflict between the drivers and management.

 

Our bin that was left full on Monday has been rescheduled for tomorrow.
