Yep, all these points we don't know. We've seen the media given prosecution and defence (aka the raid and the interview) just need to wait and see. I imagine there will be lots of numbers and percentages thrown into the mix.

I expect he will be done like a dinner, as I expect the % of legit files on his servers, and that generated his income will be quite low. Against that there is the DMCA law. But if its high profile globally, the issue of media companies drip feeding content will become a well known issue to the masses, not just the IT literate. Not that this can be used as a defence, but a mitigating factor, and that may push the media companies into being more current.

You might think that if you were going to seize property and extradite people , before doing so you would get the details right.

I hope he does get his stuff back, They are effectively charging him on a list of technicalities so why shouldn't he be able to use one to his advantage?

He won't get his stuff back, unless he is found not guilty and even then he might be subject to civil proceedings which could go on for years.

As per the quote at the nd of the article from the professor, mistakes do happen in judicial matters and whilst no doubt embarassing it won't make much difference long term.
