CamH: Anyone know if these are still available for RainCheck? If so, I'll go RainCheck one Tomorrow or Saturday.

No, I tried yesterday and even though my wife went in on Tuesday to confirm the Raincheck they still say that we should have paid then.
So we miss out :(

BTW not impressed at all with coustomer service from Hamilton branch.

I hope you weren't expecting 8 hours life out of one? On a 3 cell machine you'll get around 2.5 - 3 hours maximum depending on what you're using.

I believe he means he needs the iPod touch to not go completely loco on the 8 hour train ride, unless there's a powerpoint on the train (there is, but it's for service use only) in which case he'd get a laptop.

Yeah, I was told it would be a couple of weeks probably. I was just curious to know how many HP's they shook loose from Norman Ross, etc. I also wonder how many they ended up rainchecking approximately. Seems like they kept it pretty quiet to the general public and it was only people talking about it like us who were quick/clever enough to get the raincheck.

I wonder if it's even 100 units they need to find/substitute.

Yes it does seem that they kept it very quite about the rainchecks. I only learnt about the raincheck from this forum.

Do you not think that in a case like this, some retailers might to avoid prosecution? If a person went in on boxing day, say 10AM, and complains to ComCom that they didn't get one, and weren't offered a raincheck, I don't know if having 'limited' rainchecks will cut the mustard. Obviously its too late now, but there could be many legitimate complaints out there. Some may not consider this to be a sufficient effort on HN's behalf to do right by the customers.

Plus, the signs instore made no metion of the raincheck. That would be a different story altogether.

Just to play devils advocate :)

They dont have to offer a raincheck ever - you have to specifially ask for it.

Stores are not under any obligation to tell you of your rights, just not advise you anything counter to them.

I called HN around 9am on 28.12.09, and confirmed a raincheck for the HP Mini. This was done over the phone. I received an email a couple of days ago from HN confirming that I would be contacted in around 2 to 3 weeks when stock comes in.

No deposit asked for, not asked to come in.

There is no legal requirement for stores to offer a raincheck or advertise them. They do have to offer one if you request one and the circumstances are just that you are entitled to one.

I think a lot of people are forgetting that had HN advertised this product as being "while stocks last only 300 available (or however many they had)" they would be under NO obligation to offer a rain check. If this has been clearly advertised and you went in at 10am to find none left it was a case of tough luck. Those that queue early get the bargains. A retailer running out of stock is also not grounds for a prosecution, HN would have been able to easily say there sales may have represented a months worth of sales. It's not like they only had 1 product per store.

What HN did fail to do however was advertise anywhere that stocks were limited and continued to advertise this product it created a situation where you could have accused HN of bait advertising and the fact they begain issuing rain checks tends to indicate they felt they had possibly done something wrong.

Still to be devils advocate (I have a raincheck so I really don't care), I guess the question is wether the offer of 'unadvertised' rainchecks (do updates on Twitter count I wonder...) would counter the apparent bait advertising?

I guess a better example would be a person going in on the 27th, particuarly if he saw the ad on the night of the 26th (as it was still playing). This way, not only in there no 'limited stocks' sign but they are also advertising a product they sold out of the day before (and ought to have know would sell out on the first day) It is certainately one of the more 'extreme' cases, and if the ComCom wanted to set an example they may say that, in this case, the raincheck was insufficiently advertised and still prosecute.

I wonder how many people were told by HN staff that the current one had sold out, and were then offered another model of netbook, but at a slightly discounted price from it's RRP. They then purchased that netbook. I am sure that they would be spitting tacks if they had known that they could have got the $288 one back ordered. Is it honest not to disclose that?

I should note that JB HIFi were selling really cheap Sony Freeview TVs throughout the last week of December, yet their stock in Wellington sold out on Boxing day I was told. They also didn't appear to advertise them as 'while stocks last' on their TV ads, but I assume that they were allowing back orders, which is what Noel Lemmings do during their sale.
