There's plenty of legal downloads that chew a lot of bandwidth
if we had peering in NZ, and some international mirrors here things would be so much better, sigh

C'mon people... Read my post again. I am well aware there are legal uses for P2P distribution platforms.

My point is that regardless of the legal uses, most of the downloads are illegal material such as copyrighted content. Hence my comment about "the irony".

Did you miss the word "irony" in my post?

The Irony is a great proportion of the Internet is pr0n, spam, junk or illegal downloads.

We do have peering - just not everyone chooses to peer with everyone else :) For example we peer with pretty much everyone at APE and WIX, only major player we dont peer with is Xtra.

Peering is an ongoing discussion with the TCF and InternetNZ which you shoud see some further developments in 2008 hopefully.

May I ask you if your BitTorrent usage is just for legal content?

While I think they would be doing this to prevent their network to melt down (lack of capacity, cost, etc would be another discussion) and not to prevent users downloading copyrighted material, I find the comment ironic...

The entire concept of 'piracy' is ironic in a historical sense.

Regardless of that debate, legally speaking IMHO, an ISP places itself at significant risk by acting on complaints received about copyright infringement unless said complaints are from a New Zealand Court of Law.

In New Zealand, a person is considered innocent until PROVEN guilty in Court. Up until THAT point, the person might sue the ISP under the Defamation Act if the ISP warns, punishes, censors, or anything based on complaints received from copyright holders. Accusing someone of a 'crime' without them being found guilty is a great way to GIVE YOUR MONEY AWAY.

It is not the job of the ISP to police the actions of their customers. Addionally, by doing so anyway, they could find themselves under charges for contributory offending in cases like child porn - as the argument would be 'if they can control p2p, why not child porn?'.

It IS the job of the Rights owners themselves to seek remedy in NZ Courts. That process starts with obtaining a Court Order, and that is only granted with adequate evidence.

Given the shoddy, mafia-style law suits that the MPAA etc pursue in the USA, proof of a crime is often circumstantial at best.

It's ironic that the MPAA etc have co-opted foolish NZ ISP's into taking the risks of defending something they don't even have a vested interest IN.

I was just interested to know which ISPs have a sensible peering arrangement (such as your employer does) vs. those that force peering traffic to go overseas and back (such as Xtra).

If you don't want to/aren't able to tell me which ISP you work for that's fine

Is it working now for you? You mentioned some errors. Did you have a chance to fix it?

Actually I am on Xtra Pro and my torrents behave the same way as yours so it might be because they block it.
Are still able to send me the copy of your hacked version of uTorrent if I send you a PM?

What about the settings? I see on other forums they recommend different settings for uTorrent. Which one is better?

I tried to download some tv programs I missed in the last few weeks, but a 350MB file took me few days to download :(

If you are planning to switch ISP's you should go with Actrix. They dont block torrents and their speeds are just as fast as normal http download (200-300KB/s depends what plan your on). And between 6-8pm you have unlimted downloads/uploads at the same speed.

And thats the way it should be, People in the industry should be allowed to express their views or take people / companies to task as they do have specialist knowledge of the industry , no disrepect to non industry people here but "insiders" do have a more indepth knowledge base and can take those of us who are representing their Companies up on Claims and Statements we make. In saying that though some of the statements and foresight shown by many non-industry people are showing a lot more knowledge of the Industry than some companies , the whole LLU, Cabinetisation saga shows that, a couple of those companies may be loking for some good people I suggest they start looking here

Probably a case of too long at the coal face I suspect Mav. It is easy to loose sight of the bigger picture and become fixiated on one issue to the point where your only seeing what you want to see.
