Didn't GZ have to remove posts about customer service experience with Hosting Direct after they threatened defamation action?

Don't know alot about NZ defamation law sadly, but like most law it sounds a bit out of date.

It seems that some people want to blame the ISP all of the time, even if they deserve it sometimes. They certainly shouldn't be advertising unmetered plans as "unlimited", but most people are capable of realising that you get what you pay for ? so it must refer to a managed plan without bill shock.

How about customers taking responsibility for assuming too much when they sign up to the plan, and not asking what sort of performance to expect. Unlimited plans are slow by necessity, but few users can traffic-shape their kids or flatmates usage so there is still a legitimate place for managed plans. Unfortunately the words "unlimited" attract leechers that imagine a world of free bandwidth, and slow it down for everyone else.

ISPs have to be careful not to advertise what they can't deliver, and be upfront about acceptable use policies. Users should take the troubleshooting seriously before assuming their ISP to be running some kind of conspiracy.

And I have to say that very few ISPs allow their customers to visit and talk directly to helpdesk reps. That has to be a plus for worldnet, even though it creates other problems.




Time to find a new industry!

No. The Hosting Direct post was removed on request of the user. We did not receive any direct threats from Hosting Direct.

This, to me, is the crux of the issue:

WorldNet *could* have responded to the thread, but chose not to. This means that those who saw the discussion only saw one side of the story while those who see only this discussion can interpret the request for removal anyway they like. I believe that WorldNet missed an opportunity here, but it's their prerogative to decline to get involved in a public forum.

Given that they expressed their belief that the discussion was defaming their company, Geekzone did exactly the right thing in removing it and in being transparent about the reasons why. If WorldNet is looking at this thread they should consider posting something here. Nobody likes free speech being stifled and sending that demand is doing more damage than the original thread.

(Disclaimer, I used to be a worldnet customer and had no problems with them)

Well, worldnet not responding and deciding to try to get geekzone remove these posts says something. (To me that says "frack(Because eff is not a "safe" word) this guy"). Also geekzone complying and removing the post says something as well. Is geekzone not willing to stick up for individual posters? Or are they are saying this poster in particular is wrong?

Bugger.. Does having a .co.nz mean you're in NZ? Or having the actual server in NZ count? What about the outside NZ CDNs?

Geekzone is a New Zealand site. It is used by people from all over the world but it's a New Zealand site and must comply with New Zealand laws. Quite simple really.

Please note the update on the first post. Also at no moment has WorldNet threatened us.

The only reason for this discussion is to assert the impact of New Zealand laws in the open communications between users/consumers.

I did remove the post for many reasons, but mainly because it was a rant from a first time poster, we only saw one side of the discussion and we didn't know if all the facts were correctly reported.

People commenting here should understand that New Zealand defamation laws are not the same as in the US, which offer Safe Harbour to publishers. Those saying we are not siding with the user don't seem to know the law, and are actually tainting our image.

People commenting should also think before siding with someone they don't know, based on reporting from this same person, without any substantiated evidence.

Geekzone does not have a dedicated worldnet forum. WorldXChange/XNet does have a separate forum - But WorldXChange/Xnet are not related to Worldnet in any way at all as far as I know...
