A "fix" (of sorts) has become available, it seems:

I don't think the CGA covers this sort of thing because no one was successful with any claims when they removed backwards compatibility.

They didn't remove backwards compatibility on existing machines though, just new models. I'm sure if they removed backwards compatibility on PS3s that currently have it, there would be outrage (and a fair number of people saying it doesn't bother them because they only use their PS3 to play PS3 games).
