The analogy that "Apple built and owns the mall" does not work. Apple also controls the technology that the apps are used on. So the analogy might be more accurate if the mall owner also owned the house you rent and mandated that you could only buy appliances from their mall.

 

It is the control of the channel beyond the app shop which is a key issue.

I'm not a lawyer, but "if you want to buy apps for your phone, you must buy from us" sounds monopolistic to me.

 

 

I don't know about that, you could have bought android, in which case you are not tied into buying from apple. 

 

So, in that respect , it is not a monopoly.

Hmmm  - Microsoft got slammed for requiring you install internet explorer with it's OS. That seems pretty similar to requiring you only buy apps from the apple store. Granted not identical but close...

Not really. Microsoft were pushing a Microsoft browser on a Microsoft operating system. The app store allows anyone with a bit of coding skill to sell a product to the customer. This would only be the same if all you could get from the App Store were Apple apps.

Apple doesn't seem to really have enough cellphone market share to justify a monopoly through the App Store, a quick google says 15.1% market share of smart phones.

 

Maybe if Apple had 85-90% market share of smart phones, then there would be a concern for the App Store.
