It's always a possibility. In any case the amount collectable has to be greater then $50, but it will only be collected if you declare the offending item(s) and Customs choose to collect it.

Or worst case scenario, you don't declare the stuff and they search your bags for whatever reason and then find it, then they'll take it plus probably add on a fine!

I would have thought more direct tools, such as tagging your boarding pass in foreign country (ie oze) when you claim tax back when leaving. Differences in bag weight is a really interesting idea.

So, how would they know whether you've paid Australian GST or not? They could insist on seeing the tax invoice, but that doesn't necessarily mean that you haven't got the GST refunded using the TRS scheme on the way out of Australia.

No. If your combined value of things is more than NZ$700 then it is subject to having GST collected on it, regardless of where it is bought. Whether you paid GST on it or not in Australia, or anywhere else in the world, is irrelevant.

you probably could get away with it, as long as it doesn't look like you just purchased it (ie still in the box, sealed etc)

You would seriously be very unlucky to get pinged with GST for bringing an item back to NZ.

Take a look at Sony Style and DFS. They advertise the fact that if you go on holiday you can buy things without GST, and even choose to pick up the duty free on your return!

According to the wonderful folks at the IRD, the lower limit is NZ$400, not NZ$700 (i.e. NZ$50 GST).

It should be said that the law does not say "if Customs chooses to charge it", the law says "you must pay". So yes, not paying GST on the iPad on the way back in to NZ is technically Tax Evasion, which can get you into a whole lot of strife.

We're getting off topic here, but if you declare you are bringing an iPad into the country, and Customs (for whatever reason) simply wave you through without even asking you about it, I fail to see how that can get you into strife! Are you suggesting that you remind the officer that they should be collecting GST from you so as to avoid committing fraud and getting into trouble?!

I think we need to keep this simple, especially for people who don't know how it all works. You are entitled to NZ$700, the arrival card says that, you should declare if you are bringing in an iPad otherwise you are making a false declaration, Customs can charge you GST on the iPad which you must pay, if they don't pull you up then have entered the country just that little bit better off financially.

Insane isn't it?! Even factoring in the cost of a day trip to Australia to get one, it's still cheaper than buying this one on TradeMe.

You'd have to be pretty desperate to get one paying that kind of money.

The friend who brought in our iPad from US declared 2 iPads to customs in AKL and they just waved them through, with a comment like greedy eh? Paid sales tax in California but not GST.

Was prepared to pay GST as was not an issue if you can claim back as business.

Plus remember to all those folk who are planning on bringing an IPAD back with them from overseas, you only pay GST 12.5% on the value over $700, so for example, if you bought two ipads in the US, say the 16GB model, at $499 plus sales tax 8.75%, $1085 USD for 2, or $1550NZD for 2 at .70 exchange, then you are paying GST on the amount over $700, so 12.5% on $850, which would only be $106NZD.

If you only bought 1x 16GB ipad back, which works out to be around $775NZD, then you wouldnt pay any GST if you declare it, as it is only $75 over the $700 threshold, making the GST component only $9.37, remembering that customs will only recover GST if more than $50 is payable.

Or just unbox 1 which you are going to use for yourself, and leave the other boxed. If questioned, you took 1 out of the country with you, and the other one you purchased while away..
GST does not apply on items you took out of the country, and are returning with.
Just make sure you make 2 separate purchases at Apple, so you avoid having both IPADS on the same receipt.
I believe the limit is still 2 per person, or 2 per credit card. If you have 2 credit cards, you could buy 4 on 2 separate trips to the apple store.

Hope this all makes sense, a simple concept really... same concept applies to Australia or USA, or any other country.

Not quite. Once you go over the $700 quota you have to pay GST on the entire amount, not the exceeding amount.
