If they terminate it by repeatedly failing to deliver what they say they will, then the termination penalty does not apply, otherwise I would look forward to taking them to disputes to pick up the $150 from them.
Spoken like a man with too much time on his hands :-) But seriously, it's really off putting to think the only way out of the new service I would be signing up to would have to go to small claims to cancel due to non-performance.No assurance of winning, need to keep detailed logs and give up 3-4 hours off work and $35.
I suspect when you check the Slingshot broadband contract there will be no SLA's for them to 'repeatedly fail.'
I don't know about your experiences, but getting a Telco to admin they are offering a sub-par service and then getting the ISP to let you out of your contract is a painful experience. Those level 1 scripts are there for a reason.
At least Telecom did the honorable thing and canceled Big Time contract lockin en mass and allowed people to move to and from Big Time with no penalties.
Life's too short for bad broadband. I fear if this turns into bad broadband your stuck for a very long time, or having to go off to Small Claims.
