Hi,I completely agree and perhaps you didn't read my post carefully or took it the wrong way... because I wasn't complaining about orcon at all and don't even have a problem with its broadband (i do with its caller id though). All I was saying was that if the law says one thing, then it doesn't matter what an ISP puts on a page. I never said they were breaking the law at all, I said if that act applies ( i have no idea if it does). I haven't over simplified anything. As I said you cannot contract out of a law in NZ.
You're right, and before I understood DSL I agreed- if you can't provide the service to it's full benefits you shouldn't offer it.
DSL however, does not work like that.
If the FTA was uphelp in every case relating to DSL- there would be no DSL!
For that reason, it's a service that ISP's offer as being the best they can manage to provide.
This means that if it fails to meet your expectations, let them know, and they will get to work fixing it.

At the end of the day, it's not essential, and if you don't like the fact that it can't be guaranteed, go offline or get a more expensive option.
I'm sick of hearing of people who want 1Gbps connections 24/7 at $50 a month so they can leech illegal pirated stuff.
There is a guaranteed service out there people- PAY FOR IT! Or shut your mouths and accept that DSL is a poor man's fast internet!
PS: my international traffic is still awesome, 4mbps to LA, so call your ISP and report it.
