Must be fit for the purpose for which it is sold, for a reasonable period of time.

I'd say 5 years minimum for a item like a STB.

Having said that, I'm not a lawyer.

Warranty (or lack of) is meaningless in NZ for consumer items. The CGA reigns supreme.

I for one, welcome our CGA Overlords.

Ive been involved with 3 C.G.A cases, 2 where warrantee ones, but from memory the Consumer Mag or the Consumer devision of the Commerce Commission had a list of products and their expected trouble free life cycle.

I had a small problem with my DishTV T1050 but they did email me new Firmware but was not to do with the TV3 problem,
kept getting playback problems noise and sound drop outs , was not in the recording, as you could play back the same frames with out errors, but I seemed to had fixed it with a Factory reset retune.

This box is better than my new Panasonic that wants to record every thing in a series, like the repeats.

and what has Tv3 done? well...other than adding regional feeds at the same time they have gone from TXT subtitles to using DVB subtitles, that might be part of the issue.

In all seriousness, one peak under the hood of a regular set top box... and I'd expect it to last on average 18-20 months. The current crop of Dish TV / Loranz / Zinwell STB's are made as cheap as humanly possible.
They are the worst examples of buy and throw away gadgets IMHO.

ie is this the first time this subtitle method has been deployed on terrestrial freeview?

The Loranz / Zinwell STB's are old products the DishTV came out in 2011 and won a Freeview award as a best buy, DishTV
is has on going firmware support my last one is dated 10th Oct plus email and phone support.

Yes I am a Electronic Eng and I think that I know what I am on about.

Well my transonic and the previous DSE zinwell ran hot, no heatsinking on the chips and many questionable electrolytic caps in them also hot.

I'm pretty sure I recall TVNZ have used DVB subtitles for a good year & a half, I was sure Mediaworks did to - I should be able to check this tonight on the basis that I may have some old recordings lying around somewhere. However as something to point out, there wasn't an outage/issue with Mediaworks in Auckland, the DVB subtitles could have gone in anytime (just we've noticed them only now).

captions on 3 and 4 only came about in the week or so leading up to the changes that also broke series linking etc. Before that there were none other than if you opened up teletext on 3 and put in 801 and it was horribly broken too.
