I understand that this could be seen as a black and white issue but copyright law just isn't like that.
My comment above is quite clear on the lack of subtlety and respect for existing copyright infringement defenses (aka rights). The grey area of changes to Fair Dealing is not dealt with in this law and ISPs cannot judge infringement in these cases yet they are compelled to act.
As I'm ranting - this situation isn't a case of guilty upon accusation.
The Consumers Institute of NZ recognise that it reverses the presumption of innocence, putting the onus on customer to prove their innocence rather than the accuser to prove their guilt. I agree with this analysis.
It's about ISPs becoming accountable for customers abusing their services when it's commercially beneficial for them to turn a blind eye.
Yes, just like the phone or post service. That the government intervenes in a private contractural agreement between two people based on allegations not held up to court scrutiny is the concern.
