Lol - they're private corporations taking civil actions - nothing whatsoever to do with "public function". What act is "being done" by any entity mentioned in 3(a) when a private corporation takes such a civil action?

freitasm: If you are providing a free service and don't want to get tangled, then block P2P. If this is not possible, then stop providing the service. If this is not possible, consult a lawyer.

IANAL.

Ridiculous, I can't even begin to believe that we all let this law get passed...

You can "block" bittorrent/p2p traffic "enough" that most people won't be able to get it work, but it will involve buying an (expensiveish) router that will do DPI/decent blocking..

ALthough it'll be interesting to see what would happen if you did so and then got notices/hauled off to the tribunal. "We're a hostel and we bought/setup a router to block P2P, so it couldn't have been us"

National snuck it in under Urgency that was supposed to be for bills related to the christchurch earthquake. National seems to have done that a lot. (Hope you're voting this election and at this point it shouldn't be for National, right?)

Not old enough to vote at this point, and even if I could I don't believe that any of them really stand to represent the public and their opinions. Somebody should go torrent a couple movies in Parliament/Council or something and get their Internet cut off, that might make them want to revise the law (not that I would endorse that, just a thought).

Maybe an ISP could sell it as a service as they have the cool boxes and do all that deep packet inspections.

They could! But if someone sneaks some P2P in there, you the account holder will still be responsible :)

Urgency just means the house sits for longer to get more work done, the bill was in their queue of stuff to and would have been passed anyway.

That aside the new law is still retarded/disappointing... the technical illiteracy shown by pretty much all MP's from all parties debating the bill was massive.

I hope you're unaware of everything else you'll break using OpenDNS in New Zealand including breaking virtually every CDN?. Unless you are fully aware of these risks you should not be using any 3rd party DNS servers.

What is the process of becoming a registered provider so you can pass on the notices?

And what happens to organizations that aren't ISPs but have their own IP space and AS'? DO they just ignore the notices?

QFT, you'll severely restrict your performance in this day and age by not using your ISPs DNS servers unless you really know what your doing. A couple of years ago I actually had to use Callplus' DNS servers on an ICONZ connection so I could get a local AKAMAI node. Using OpenDNS is almost guarenteeing you won't get local CDN content which includes things like youtube caches these days.

If what we all choose to believe about politicians is true, theres a high probability that they won't need any help with this.

And on top of that you've got the petty politics of political personalities to factor in... so what are the chances of them pinging themselves... it would be great to see the first offender from somewhere within the legislative corridors.

You folks seem to have very short memory.

The Copyright (New Technologies) Ammendment Bill was introduced by Labour (Judith Tizard) in 2006.

There was some public demonstrations against the S92a (the specific point in the three strikes) in Feb 2009, and the then National government decided to delay its introduction.

And this year whole government (including labour) approved this fine piece of legislation.

So now you tell me Labour comes out saying they will repel the law if they get the government? And people say they will vote National out because of this law?

Seriously folks, it's the same thing as before. It's one party riding the waves to try to get votes by proclaiming loudly they will repeal a law that they introduced in first place.

Everybody says it's impossible for a person or company to be an IPAP an an account holder - a scenario which does exist in the real world.
