Quite possibly.

And, maybe even if you don't download movies.

The rights holder will want to catch their person. . . the best way for them to do so is to file 3 notices over 3 months for an ip address.

I'm taking the mindset the law will be abused of course. Maybe the rights holders will act correctly which is great. But, it would not the first time companies / people have abused weak and poorly drafted laws :)

So, my question, is , can rights holders easily fabricate an infringement notice? How can an ISP customer disprove a fabricated/incorrect infringement? I'm not sure what this PAP is, but, isn't it basically IP address, date/time and copyrighted material information. Or, is the pap some kind of technical data that can be compared against telecoms tcp/ip connection logs?

The short answer is that it's near-impossible for the account holder to prove innocence as your computer and modem/router won't have logs that'll help you (from what I've been told). Unless you install monitoring software on your computer(s) that takes logs of internet activity, you're reliant on contesting points of law at the Tribunal.

rugrat: Can the isp look at what internet addresses at the date, time were being accessed to confirm it's not a bogus claim?

TelstraClear don't (or at least didn't use to) have any record of this information. I had trouble with unexplained excessive internet usage, and asked TelstraClear for help but they very clearly told me they do not keep records of this type. I am pleased they don't (or didn't) as it is quite an intrusion on my privacy.

I'm gonna put some random static IP in my utorrent as my IP so that at least I am advertising someone elses IP to the tracker, so if that is all that they use to base the notices on, someone else will get the notice.

Anyone know a way to find MP's home internet connection IP addresses at all?

I wonder if NZFACT have their own static IP, and if they know what it is?

Could be hilarious to see them send themselves a notice, pretty sure they would uphold that challenge...

If you get a couple of notices from your ISP, couldn't you just cancel your account and go to another ISP?

Then you'd have a "clean slate" ?

Yes, and an early disconnection fee is a lot cheaper than having to turn up to kangaroo court, even before they give out any "damages" etc

I'm stuck with Xnet until more ISPs hop onto Chorus' fibre network.

I don't even have the choice of switching ISPs if I got 2 strikes (other than using mobile data, but yeah nah)

I'm not sure it would help. If I were a rights holder I would coordinate my notices, that is, not send the first two until I had the third ready to go, and then send them all off at once. No sense scaring off the marks, is there?

They can only send one notice at a time and only one per month.

There are quite long durations where only one notice is in effect, and then a time after it for disputes etc that a second cant be accepted.

Whatever, get notice 2, change ISP, change account holder on the connection or whatever is needed to start again. Anyone who stays with their ISP after strike 2 IMO is an idiot.
