Its most probably illegal (unless its a creative commons licensed movie - not a hollywood one), but this particular law doesnt target those sorts of sites i.e. you wont get a strike from using rapidshare.
In the case of those sorts of sites, the 'hunt' tends to follow the person who uploaded it or rapidshare itself, but as you know, such sites do still exist
