hellonearthisman: This law is a badly written law, 1st it's guilt on accusation and 2nd yes you can get a notice dated 21 days before the law came into effect.

The 21 days is irrelevant, the bad part of the law is 122N where it is up to you to prove you didn't do it. I think the rights owners should have to produce more evidence, such as proof of the methods they followed to identify you as sharing copyrighted material.

The way the law is written at the moment the only way to prove your innocence would be, for example, if your internet was broken at that time.

It's also $25 + GST per notice, not $20.

Yeah, as things stand you are right. I think you would agree with me that such is not in the spirit of the law but that doesn't make you less right.

The more I read this thread the less idea I have of how this law is actually going to work.

Didn't anybody tell you I was a hacker?

For crying out loud, he is hitting every point that has been made on these boards and we (like us) is right:

This is what you get when the MPs passing the law refer to it as the "Skynet" legislation. Yeah, because The Terminator was all about illegally sharing files, or technology ... or something.

I guess the other option is to vote for a government that will repeal the law.

I think there should be 'copyright law'. People who produce stuff should be able to get fair compensation and should have an avenue of redress when things go wrong.

But the law actually has to be seen to be reasonable by most people and actually clearly say how things are going to work.

Things with this law started badly with those drafting the legislation and trying to convince us it is fair clearly not understanding the internet ... and went down hill from there.

What the court offer us is the chance to establish precedent as to what you can and can't actually do. To define terms such as 'fair' and 'reasonable'.

Mind you the courts don't have such a great record when it comes to the net.

Hi all

When a letter is recieved, is there a lead time when another letter won't be sent to allow the account holder to resolve the issue, i.e. stop the infringing?

That is very interesting, I wonder if other ISPs are experiencing the same response.

I have a question.

After 3 notices you go to a tribunal. But does it have to be three notices from the same person complaining? Or just 3 notices in total?

Because I am under the impression the MPAA aren't the only people that can complain you are downloading since it was mentioned somewhere "multiple companies are already taking up on this new law".

EDIT:

Is it just my machine or does "3strikes.co.nz" re-direct to a torrent hosting website? That is quite funny. :D
