We're trying to get a phone connected at our bach, note this is the actual phone line we're having trouble with and not a broadband connection. Chorus are saying its not possible due to insufficient lines comming down from the top of the road 1km away, a new build is required.

Our bach is on the west coast, Glinks Gully to be more exact and its the first time our bach is getting a phone line connected.  The etp is already there from years back when everything on our side of the road (inc power lines) was put underground.  There is one very thick overhead line coming down from the top of the road which contains all the phone lines.

Whats the legal obligations of chorus here? In regards to supply of a pots.  I understand with broadband there is nothing you can do if your a port waiter.  Unlike with power and water which are necessities, does a pots fall under the same category?  Right now its basically either wait for a spare line, or wait for a new build.

I'm not sure whether there are any obligations here. I was under the impression that the TSO required Chorus to make phone service available to anyone that requested a connection but after quickly looking at the TSO document I didn't see that listed. However go through the document yourself and see whether you notice anything.

Unfortunately that document isn't searchable!

Have chorus said they wont do it - usually if there is insufficient capacity in a cable it will b sent to build for more capacity to be added

From the sounds of it if a new build is involved all it requires is a few more parts of chorus doing some work and can take some time depending on the level of design you need.

I would be surprised if Chorus has said no outright but in some cases this has been true.

If you have mobile coverage you could check out Home phone wireless but it does look like mobile coverage is very limited,

Absolutely no vodafone reception at all there unless we drive the 1km to top of road, Telecom is also very much the same.  One of the other baches is running a suresignal so we usually walk down to their place to get our texts etc...

I have had a look at the address and discussed with my colleagues at PSTN waiters. As service was not requested through Telecom it is hard to get accurate information from Chorus. It could be that until Chorus complete a cable overlay in the area that there will be no spare capacity to connect any more lines. From a telecom perspective, if this were the case, the connection order would be held open pending that network upgrade. I have advised the OP that I can't get a better picture of the situation unless we issue a connection order.

Make friends with suresignal bach, they clearly have broadband, maybe you could share?.  Run a wifi link to them (gear is ~$300), plug a VoIP adapter in, sign up to WxC VoIP ($11ish/mo).  Done.
