I am not sure about how the law would treat it, in terms of it being non-charged. If it's included as part of a subscription and not sold separately, I am pretty sure legally it's bound by the services of the subscription it was parented from and therefore must be "fit for purpose".
It's potentially possible I'd expect, for a customer to make a complaint based on the fact that the SkyGo app is a key reason for their subscription to Sky and this would be pretty compelling from a legal investigation standpoint.

I had a chat with the Consumers Institute after SkyGo failed the last time. Their opinion is that SkyGo is not a free add on any more and it is now a part of the subscription. As such, it is subject to the CGA and, as a result, Sky cannot use terms and conditions to get themselves out of the requirement to provide something that is fit for purpose. Obviously, they cannot be held responsible for problems outside of their control, like your own internet connection, but the system should be reliable. The case is strengthened if you use SkyGo as a key part of your subscription (as @networkn alluded to).
Their recommendation is to lodge a complaint with Sky in the first instance and then, when you get the inevitable refusal to deal with your complaint, with the Commerce Commission. Until consumers start to lodge complaints over Sky's monopoly abuse then nothing will be done about it.
