I am not sure about how the law would treat it, in terms of it being non-charged. If it's included as part of a subscription and not sold separately, I am pretty sure legally it's bound by the services of the subscription it was parented from and therefore must be "fit for purpose".

 

It's potentially possible I'd expect, for a customer to make a complaint based on the fact that the SkyGo app is a key reason for their subscription to Sky and this would be pretty compelling from a legal investigation standpoint.

I had a chat with the Consumers Institute after SkyGo failed the last time. Their opinion is that SkyGo is not a free add on any more and it is now a part of the subscription. As such, it is subject to the CGA and, as a result, Sky cannot use terms and conditions to get themselves out of the requirement to provide something that is fit for purpose. Obviously, they cannot be held responsible for problems outside of their control, like your own internet connection, but the system should be reliable. The case is strengthened if you use SkyGo as a key part of your subscription (as @networkn alluded to).

 

Their recommendation is to lodge a complaint with Sky in the first instance and then, when you get the inevitable refusal to deal with your complaint, with the Commerce Commission. Until consumers start to lodge complaints over Sky's monopoly abuse then nothing will be done about it.

An interesting opinion from the Consumers Institute.  Can we debate a few hypothetical questions from this?

 

- What proportion of the Basic monthly fee could be attributable to SkyGo?  And what reduction in the Basic package would result from Sky pulling SkyGo completely?  

 

- Would we see behaviour similar to, say, the airlines?  If your special meal doesnt come during your flight then they give you a voucher to use on your next service (I think AirNZ gave me 40 Airdollars from the last time they didnt pack my request) - cold comfort for food on a long-haul flight.  So would Sky give a deminimus discount on your next monthly bill?  Again cold comfort for SkyGo falling over on the live event that you wanted to see but would never be repeated again - and even colder comfort for the majority of SkyGo users that are using their cousins/brothers/mates login - as they would get the discount and not the person inconvenienced!

 

- Would Sky pull the product completely for live sports and keep the other channels?  And force those out-of-home viewers to buy FanPass for the single event that they want to see?  Ouch.

 

None would be popular moves but Sky is not known for its popularity.  And do you think that these may be more likely responses than actually spending money to beef up capability?

By that theory, they should temporarily shut down their satellite service too. It's not hard to rip that video feed either. If that's actually why it's down, that's insane.

 

I've solved my issues by just re-broadcasting a SKY satellite feed to a private Youtube channel, in full HD glory.

 

 

The 26 live streams for Sky customers are on their Olympics app and also suppose to be on their olympics page. I expect they are clean feeds from the broadcast host e.g no logo, same as the one in the Aussie app.

 

I think they won't want Fairfax having easy access to high quality streams via the desktop since it doesn't have the Skys logo on it.

App streams have a Sky Sport bug on top right.

Thanks, I'm aware of how the OBS white label product for providers works.

Regardless, if they have actually shut down a service because of this issue with Fairfax (which lets be honest looks more and more likely with each day that passes) that is an extremely ridiculous way to proceed.
