What happens when you make a claim? Do they take the old phone back off you? Because I heard of someone keeping their old phone and getting replacements so wonder how the telcos ever make money.

The reason I am asking is I recently bought a second hand phone off trademe so am wondering what the chances are that it was an insurance claim and is going to be locked?

Depends on the insurance company, When the insurance company pays out a claim, they take ownership. I have had claims where they don't want the damaged goods back then others where they want it back before they'll process the claim/

IIRC the Telcos don't do the insurance themselves they simply resell a policy under written by one of the large insurance companies.

I think you have more risk of purchasing a stolen phone off trademe rather than a ex insurance claim phone.
