Hi all,
I purchased a genuine Samsung battery for $48 from a store called gadgetsonline in Auckland last October.

It has begun to swell to the point where it will no longer fit into the phone.

My two emails to the retailer has elicited responses that "their policy is to warranty them for 3 months"

This is unsatisfactory.

Is the only way forward to threaten legal action (which will cost more than it's worth) or can I contact Samsung NZ directly?

Change the heading to include Gadgetsonline so searches will pick this up.

CGA should cover this.

I would contact samsung. You can go to the manufacturer. The CGA does require things last a reasonable period of time based on the value of it. A swellng battery sounds like a failure of the product, rather than wear and tear from use. eg The battery shouldn't swell, but a battery will lose it's capacity over time.

Potentially dangerous?  Is it genuine?  If so I would contact Samsung asap.  I have had good dealings with them in the past, very reasonable.  




Lazy is such an ugly word, I prefer to call it selective participation

In which case lay a complaint with the proper body and see the retailer automatically change its attitude to the CGA.

If something you buy turns out to be faulty

 

Neither a manufacturer’s warranty, nor an extended warranty, replaces your rights under the Consumer Guarantees Act (CGA). And the business can’t tell you that it does.

 

If you buy something that turns out to be faulty, you can choose how you’d like to sort out the problem. You can choose whether to go to the manufacturer or the retailer. A retailer can’t refer you directly to the manufacturer if that isn’t your choice – even if the manufacturer’s warranty is still valid. 

 

What can I do if something I bought didn’t last as long as I expected it to?

 

Take the goods back to the business if you can and show them what’s wrong. Explain that under the CGA they must repair, replace or refund the faulty goods if the problem is minor or give you a refund, replacement or compensation if the problem is serious.

 

You can also go to the manufacturer or importer to get the problem fixed. You can use the manufacturer's warranty or your extended warranty if these apply to your problem.

 

What if the business or manufacturer won’t fix the problem?

 

Write a letter to the manager or the head office of the business. Explain the problem and what you’d like them to do about it. Keep a copy of the letter.

you deal with the people you brought it off, not the oem.

quite the CGA and polietly advise them if they dont attempt to fix it you wil take it to the Commerce commission

I have already emailed the retailer twice and had the same nonchalant reply that I'm outside their warranty conditions, despite quoting some relevant text from the CGA. Short of threatening to go to a disputes tribunal, where the fee will be nearly comparible to the battery cost, I'm running out of ammunition. I guess I could post negative feedback on facebook/pricespy etc.
However the CGA allows me to approach the distributor, hence my request for a contact at Samsung.
