Yeah you'd be best to approach the company you purchased this from in the first instance, assuming it's not second hand.
There are options to rebuild the hard drive and software yourself if necessary, but no guarantees this will be successful, and certainly you would be stuck if you had an actual hardware fault elsewhere in the unit.
It came from Spark in its Telecom days as a carrot to get me to re-sign my phone/internet account for another year. Probably a couple of years ago now.

Standard 12 months from memory. Had to have been longer than 3 years ago? I would think even a CGA claim would be pushing it.
That said I have had my TiVo's replaced with refurb ones by Spark on 3 occasions over the last 18 months. The last time I wasn't even a Spark customer. Just rang the TiVo helpdesk (Spark), asked for advice on the problem, they went through the standard scripted trouble shooting stuff, then announced a replacement was on it's way. Didn't ask anything about how old or anything. I figured they are just rolling them over until they are all dead.
Lazy is such an ugly word, I prefer to call it selective participation
