I've bought a used Tivo which is still activated in the name if the former user who has now shifted to Oz and is out of contact.

How do I deactivate this Tivo without the login details of the first owner?

Contact the TiVo helpdesk.
I recently went through a similar process and found them very helpful.
I bought a TiVo off a chap who had bought it off another bloke, who'd since moved overseas.  The unit had never been deactivated from the original owners account, and the second owner was not able to get in touch with the original owner.
In step the TiVo helpdesk.
They endeavoured to contact the original registered owner to confirm the legitimacy of the sale.  They were then able to deactivate it from their end and I was able to activate it and attach it to my existing TiVo account easily.
I found them very helpful, they were communicative and clear, both willing and able to help, and pro-active.  They followed up with me to make sure everything was hunky dunky.

Indeed. It pays to get a receipt from the vendor. If you email a copy of this to TiVo support, this is usually enough.

Success! It went exactly as described here. I now have another activated Tivo that arrived still linked to the former owner's account.
