As more workplaces setup vaccine requirements, is there a legal issue about terminating them if they cannot WFH due to whatever issues (power down, internet down, or employer cannot provide much work if they can only go to clients/sites that accept non vaxxed) and cannot go to the workplace?

It doesn't appear so.  My org (1600 people, large local public body) has mandated that those that interact with the public during work time (this includes travelling on PT to meeting) shall be vaccinated.  They've got until the 24th I think to prove second dose otherwise they are no longer working for AT... I presume that for those that are not public facing and can WFH then the minor loss of power etc. won't be considered to be an issue or the work has peaks and troughs.

It is only set in stone for some sectors (teaching/health etc) where they had a defined date and termination notice of 4 weeks later\.

 

For others. It is the usual softly softly approach. With words such as 'fair' and 'reasonable' brandished a lot. With fallback to 4 weeks paid notice if unable to reach an agreement

 

Basically, you can't sack them for not being. BUT if they no longer meet the ability to complete the role they were employed for, or it gives them very little opportunity to be able to continue usual employment within the company. You can part ways as unable to fulfill role anymore.

Has there been any clarity on whether we'd revert to reigonal lockdowns in the event of a sudden, large-scale Omicron outbreak? 

 

Gut feel suggests we could be in for a very short regional lock-down if/when Omicron leaks to ease the pressures on the health system if RED doesn't have the ability to stunt it. Trying to plan accordingly.

The Government doesn't want to go back to a lock down (especially in Auckland), but it highly unlikely to adopt a "let it rip" approach...

 

it will pretty much come down to hospitalisation and ICU, if they get swamped  I would expect the government to move to some restrictions stronger the "Red" setting...

 

But as with all things COVID, until it happens we wont know.

Off course he was aware he's just playing games, gets in the news, the bill is in the shredder. Middle finger to everyone else especially the neighbours. Our laws probably don't allow the Police to cart them away

I have heard Hipkins say they will use micro lock downs based off all the usual criteria, so vaccination rates, the infrastructure issues etc.

 

I have no idea what they will do. However I expect the messaging will change to overt statements about less severe disease in the vaccinated and living with the virus as seen elsewhere.

 

That is not the same as let it rip. That is an admission that the virus cannot be stopped however people need to protect themselves all the same in practical ways to at least attempt to influence the speed of the exponential growth curve.

I think de emphasising the case numbers, i.e. "New record cases again today" and focus on hospital beds and ICU. But yes, restrictions as and where needed to keep beds and ICU in check. Also advise the beds and ICU for vaccinated and unvaccinated, an indirect way of naming and shaming, especially when the careful people are locked out of operations due to the unvaccinated taking up room

That all makes sense to me. Unfortunately we live in a world where people who do not follow the health advice get preferential treatment in our system due to the consequences of their decisions.

The state of Victoria is a bit of a mess in terms of health care. Second Ambulance code Red called overnight with 25 status one patients unable to get an immediate response, no word on how many of them died.

 

The down stream effects of Omicron are really what is making it worse than Delta.

 

Of course in Victoria where there has been the strongest antivaxx movement, they have been suffering a very long Delta wave, which omicron is now coming in over the top.

 

The real alarm is that the Ambulance Union are expecting more code red nights and even the possibility of several days in a row where you cannot get immediate assistance for things like heart attack. Excess deaths then look to rise in the state.

 

Hospital numbers have hit an all time high for the State of Victoria and what concerns me most, is that they are more similar to New Zealand in terms of their health infrastructure than say the massive system they have in NSW.

 

It is very clear now that New Zealand is in for a hard time, however as I always say, the vaccinated among us, are very well protected from the worst of it.

 

The one million unvaccinated citizens is our weak point.
