Isn't what was suggested earlier that he did have a claim of right, because he had access to that database as part of his job - even if using the data in this purpose was not related to his job?  I suppose they could play dumb and state an assumption that because he had access to it, that he believed this was allowed...and thus it didn't meet the "and without claim of right" requirement regardless of whether it caused a loss?

That access would ONLY be as part of his job, what he did was completely outside of the requirements of his job.

 

ANY and ALL information available was not his to take, he had zero ownership rights over the information.

 

I would argue the emotional etc harm done to the victims of the information leak is a loss too.

Unless his Employment Agreement or other policy statement that he has read and agreed to by signing it is clearly worded to the contrary it, might be difficult to get a conviction.

 

If he insists that "I believed I was entitled to access & use that data and nobody ever told me to the contrary" and says "look how careful I was to protect individual privacy, all the information I made available to inform the public was anonymised, I believe(d) I was acting in good faith" and there's nothing written down & signed to the contrary, it's maybe down to the alternative charge:

 

Health Act 1956 Section 22C (4)
Information provided or obtained under Part 3A may not be used or disclosed by anyone except as authorised or required under a provision of this Act or another Act

 

And the maximum penalty is
Health Act 1956 Section 136
Every person who commits an offence against this Act, or against any regulations made under this Act, for which no penalty is provided elsewhere than in this section is liable on conviction to a fine not exceeding $500 

 

 

 

Which would be correctly perceived by the public as a disastrous fail by Te Whatu Ora

I dunno, I've always thought as soon as you did an interview with a nutjob like Alex Jones, all your credibility goes out the window - although it doesn't sound like this idiot had much to begin with.

 

Come to think of it, why is he even giving interviews with anyone? Isn't he meant to be on bail and not meant to be accessing the internet?

So, what's happening with the self-described "whistleblower"? Has he got a court date yet? Is "lawyer" Sue Grey (lol) representing him?

 

I believe that Liz Gunn has completely gone to ground and is "taking a break" over Christmas and New Year, instead getting her poorly-dressed henchma...er...sidekick - I think the "cameraman" involved in the assault at Auckland Airport earlier this year - to host videos in her absence.

 

Man I wish I could take that much time off and still watch the grift...er..."donations" keep rolling in 🙄

Drawers and boxes of RATs into bins at present. The main supplies all hitting expiry Nov/dec.

Free until Feb 21 only. I know a lot of workplaces still using them to filter out outbreaks. I guess since the likes of chemist warehouse are still selling them they'll continue to cash in until theirs do.

Now to find someone doing walk ins for #5

My local Chemist Warehouse is giving RATs away for free.
