Not a 'fine'. Only a Court can fine you. And it takes a statutory authority to issue an infringement offence notice. Private individuals and companies have no power to do either.

The Uber driver was obviously ignorant as to his rights. He should have removed the clamp by whatever means necessary instead of giving into this extortion.

I agree that people parking on other's property without permission should be given a deterrent to prevent them from doing so again, but you just have to look at this guy's history to realise that he is being completely unreasonable in terms of the "fines" he charges. That is not excusable.

Also he portrays a very unlikable persona which immediately puts a lot of people offside. I feel he deserves the flack he is getting given his approach on the issue. Sounds like he earns a better living from his clamping activity than his antiques store...

Simple solution (but he's looking for money, not solutions):

Set up a small chain across the carpark spaces he owns. Cars trying to park there would either be unable to park or would be damaged doing so.

He's not in the least bit a civil-minded gent, though. He's a greedy bully who thinks he's above the law (and continues to be proven right).

Then why not make the fine 10 million dollars? Or ones eternal soul?

Surely the law protects against crazy penalties? If so, then what is the amount that determines between fair and unfair for something like this?

When I owned a shop we constantly had people blocking in all the staff out the back cause they just didnt give a crap where they parked- it was private property and there was literally a hundred or so free carparks 10 meters away. I had a tow company on tap to tow people. They would patrol the area regularly and they would tow at least one a month. There was plenty of signage stating if you park here you will be towed at your expense. We made nothing off the deal other than having idiots threaten us over it constantly - I was only there 5 mins blah blah blah. But why should I or my staff be inconvenienced, sometimes for hours by an ass.

Clamping, well thats a whole other story. I think thats clearly a revenue gathering exercise. Especially after hours. Id never clamp someone, Id rather have them removed. But I also think its the persons right, its their property. As long as it clearly states its private parking etc then really why should anyone complain when it happens to them.

I'm probably in the minority, but I have absolutely zero sympathy for the people that get clamped by this guy.

Sure, he sounds like a "completely unreasonable gentleman" <- note submissions are open for understatement of the year award ;-)

...but the fact is, it's a privately owned carpark. You won't be clamped if you don't park on someone else's property. Every story I've read about this place has been filled with aggrieved drivers making excuses for their entitled behaviour. "It was only for 5 min." "It was outside business hours." "Nobody else was using it." "I wasn't inconveniencing anyone."

The solution is simple. Stop parking on other people's property and you won't have to deal with over-priced clampers.

I have similar intolerance to people who park in mobility parks when they don’t have a permit because “just stopping a short time to go into the shop” I wish I could clamp their vehicles.

With any luck he uses the same wheel clamp that is available from the two major auto parts retailers.

The reason I say that is because I bought one brand of clamp in 2015 from one of these stores, then in 2016 I bought the other store's home-branded clamp which happened to be the exact same design. These were bought about 18 months apart, are technically a different brand of clamp, yet all keys work in both clamps... Very handy for me, but also handy for thieves which somewhat defeats the purpose.

A one in 100,000 coincidence? Maybe, but I then tried one of my keys in my friend's clamp which is about 7 years old. It needed a bit of a wiggle this time, but hey presto it opened too.

I guess at the end of the day, clamps are just like front door locks on houses - they really only keep the lazy thieves away lol

I recall that there are also residential(?) tenants in the same building, hence even after hours people will get clamped.

From what I understand, the owners of the antique business actually own the whole building, and live upstairs - I assume he spends all his free time looking out the window. At least it's a hobby that pays handsomely I guess.

Or you could buy an old dunga for a few hundred, park it, wait for his clamp, then, whatever he wants to charge you to unclamp, ask him to pay double to remove the car - pay up, or I leave it here!
