Update:

Still no reply regarding the legality (Or anything)

Spoke to the Traffic Engineer for this area the other day too.

Only bit I got from him was that they were looking at the issues and that they wouldn't be putting the "hockey stick" parking markings around the Fire Hydrant"

"As if they did it here - Everyone would want it!!!" - Unbelievable reason!!!

Under North Shore City Bylaws, it is illegal to park blocking the foot path, or to damage berms - however you can park on then as long as you don't damage the grass.

If the Council's accessible records mirror what's online they probably don't go back far enough to cover the time the markings were done. Maybe the school/church could advise when their car park driveway was done. That may provide the year. The hard copy back further than 2000 is probably in storage.

Just received an email from the Traffic Engineer for this area: (Complete text below - yes one line)

"Just to update you that the proposed no stopping restrictions at Arthur Street/ Middleton Road is currently undergone to consultation. I plan also to resolve the whole Arthur Street at the same time."

No time frame given - but given there is STILL NO ANSWER to the ticket legality question after almost 2 months, I'm not holding my breath.

From CCC Traffic Engineer for this area:

"Just to confirm the community board has approved the no stopping lines on Arthur St / Middleton Road intersection. This will be marked within the next two months.

Also I have re-resolved the whole Arthur Street parking restrictions and community board has already approved them."

So before this month the infringement notices appear to have had no legal status!

The yellow lines were removed when fibre (Pipes) was put in 2 years ago!

Complete with developing sinkhole where they (Fibre trenchers) broke the gutter and the road is now slumping.

(CCC notified 17/5)

Actually I believe it as the rules for parking etc and more so use of roads and how to use them are covered in the Road Code. It is drivers responsibility to see the fire hydrant (which is clearly marked) and obey the rule in the road code that says dont park on it.

Its like passing school buses....everyone knows (from the road code) the speed limit drops to 20km but you dont see 20km signs on the back of school buses...instead you see "School".

Disputes tribunal adjudicators use the road code. I was involved in an insurance claim and they literally got out the road code and started reading it.

Doh, bird just flew into the house!! Gotta dash.

Good for them, but it's a shame they didn't read the disclaimer that states it is only a guide and does not override the legislation, which can also be found in the online version.

Interesting that the CCC don't paint the circles around hydrants any more unless there is a complaint!

Especially:

L3.1 Required markings for underground fire hydrants located on or
adjacent to sealed roads
The position of the underground fire hydrant must be identified by:
(a) The lid of the fire hydrant box painted with yellow paint; and
(b) An isosceles triangle of solid colour with 600 mm sides and
450 mm base, painted yellow, on or near the centre of the
carriageway, with the apex pointing towards the underground
fire hydrant; and
(c) In addition, a circle of 1.2 m outside diameter with a line width of
100 mm painted yellow as concentrically as possible around the
underground fire hydrant, where, in the opinion of the person
responsible to the WSA for the installation, maintenance, and
marking of fire hydrants, access to the fire hydrant may be
obstructed by parked vehicles.

Fire And Emergency New Zealand (Was the Fire Service) are writing to the Christchurch City Council to remind them of their legal obligations.

Whether anything changes is yet to be seen!
