(a) acquires from a supplier goods or services of a kind ordinarily acquired for personal, domestic, or household use or consumption;. 

 

A utility is a commercial vehicle. 

 

Not in all use cases. A friend who lives just up the road from me owns a ute which is purely personal use. It has a variety of uses from towing his boat, or a general trailer, to commuting - zero commercial use. I can guarantee there's plenty of other people out there who don't use them commercially either.

Hi wheelbarrow had a similar problem with Smith and Smith, my windscreen was not sealed properly and created a loud wind noise on the highway.

 

The S&S franchise that fitted the screen (Ashburton) didn't want to know about it.

 

So I uploaded a UTube video outlining my concerns (showing the noise), and explaining what poor service I received from S&S.

 

The very next day I had the S&S marketing manager ringing me asking what they could do to rectify the situation.

 

They then organised for me to get a new windscreen install FOC -good result overall.

 

 These companies are highly conscious of any bad publicity on social media maybe its worth a try!

So it appears all parties involved have done a U-turn since my last update on Friday:

 

You will recall that Smith & Smith were only willing to commit to install one of their own aftermarket replacement windscreens free of charge.

 

Ford NZ were saying that even if my faulty windscreen was still within warranty (which it's not), they would only have replaced the screen itself - not including fitting costs or recalibration of the collision mitigation/lane guidance systems.

 

Smith & Smith just called me to advise that they have now reached an agreement with Ford NZ, and on Wednesday I am booked in to have a new genuine Ford windscreen fitted by Smith & Smith, followed by a recalibration of the safety systems.

 

I am very pleased that common sense has prevailed, and that I will soon have a new windscreen that I can see through 100% of the time. Thanks everyone for your advice.
