Jase2985: "When leaving and entering driveways

When you are entering or leaving a driveway that crosses a footpath, you must give way to people using the footpath.

When leaving a driveway you must give way to vehicles using the road."

from the road code

I encounter this every day walking down to the train station. People just don't get that you can't block a public footpath whilst somebody is walking on it.

I understand the relevant legislation is Section 4.4 Land Transport Road User Rule 2004 Pursuant to sections 152, 153, and 157 of the Land Transport Act 1998

4.4 Giving way when entering or exiting driveway
(1) A driver entering or exiting a driveway must give way to a road user on a footpath,
cycle path, or shared path (as described by clause 11.1A(1)).

Drivers should be prepared to give way to peds crossing and not just barge into side streets as if they have right of way. .

they dont have the right of way?

Slightly related question: Who has right of way when a car wants to turn off the road and into a driveway - the pedestrian or the car?

So if a pedestrian is walking along the street and is about to cross a driveway, should they wait for the car or should the car wait for them?

The car because:

Section 4.4

Giving way when entering or exiting driveway
(1) A driver entering or exiting a driveway must give way to a road user on a footpath,
cycle path, or shared path (as described by clause 11.1A(1)).

Not exactly where I thought that was going. I thought that the next step after putting lights and sirenes on was to pull you over and issue you a warning for using your horn.

I have seen police crossing red lights without lights or sirenes, so not that surprised.

Of course this near-miss would have been a perfectly valid use for a horn aka "Audible Warning Device", police or not.

This is the one that gets me annoyed the most.  I walk to and from work every day and regularly have cars trying to enter or exit a driveway that I'm walking towards.  I'm never a dick about it.  Generally if a car needs to leave and clear the road, especially if its busy or they have been waiting to cross the line of traffic and finally get a break, I wait.  If a car was already in the drive waiting and I walk up to it, I don't expect them to reverse to let me pass, I just walk around.  No drama.

But the dudebros who are driving up to the exit as I was already crossing and lay on the horn, or are going in the same direction as me and try to drive in as I was in the process of crossing and lay on the horn, gets me cross.  I seem to notice my untied shoelace at that point (double knot and thoroughly checked of course).

I am going to assume that most of them believe it is them who has right of way, based on the abuse I get.

Sweet Cheesus... Driving on the Wellington Motorway for a bit these days (bathroom renovations, so commuting to in-laws for a shower every day) and the number of idiots driving at 80 km/h on the right side of the lane motorway... What a bunch of stupid drivers.

Worst is when this driver goes three kms on the right side of the road, then change lanes at the last minute to take the exit left. It's not even like they are driving on the right side expecting to exit on the right side. They are just plain stupid.

off topic a tad but you just reminded me we are about to rebuild our bathroom. I am thinking of hiring a camper van to use as a bathroom. So now on topic I wont have to endure crazy driving being driven  to have a shower in the morning

Here is a crazy notion, lets give peace a chance.

Three weeks bathroom renovation. Just at the end of second week so if all good we should have a shower again next Wednesday (floor being done Monday-Tuesday). Wife/daughter sometimes go to the Jville pool for a shower but it's cold and the shower is really "thin" so I rather drive to Plimmerton, have a good shower, dinner and then back home. We thought of hiring a portable shower but they'd be plastic things parked in our driveway, gas-bottle powered and cost $300/week. Not worth yet.

Yep, I see this every time I drive to/from work. Sadly most of them seem to have no idea what's going on around them especially behind them. The rear view mirrors might as well not be fitted.

What amazes me is the other drivers that just avoided a car ROLLING DOWN THE ROAD and didn't stop to offer assistance....
