Rikkitic: I haven't seen a Harvey Norman ad in years. I also haven't bought anything from them in years. I became so incensed by the screaming that I started hitting the mute button or channel selector whenever one of their ads came on. It is now like an instinct. If that is what they are trying to accomplish, it has worked very well.

Whether its HN, thirty minute walk away, etc, I buy wherever the product or price suits me, I don't let ads reduce my choice.

This story doesn't seem to be dying http://www.stuff.co.nz/business/72722258/harvey-norman-customers-may-seek-legal-action-over-online-sales-glitch

A pity the media didn't get behind the JB Hifi Tablet one, which IMO was a far less obvious pricing error.

I think this is turning into more than a HN thing now. It's more to do with what is inside and outside of the law and when a sale becomes a sale (i.e. When the money is charged). Most online companies but a "hold" or pending charge until order is ready to ship HN doesn't they charge a customer at time order is placed.

Clear rules need to be shown. Even HN T&Cs say 2 different things (1 that they can reject an offer to buy until it's accepted, but then says its accepted when you get an invoice). Well their system produces an tax invoice at time of sale so everyone that ordered does have a tax invoice which under HN own T&Cs is an accepted order yet they cancelled all orders point to their T&Cs saying they can until they accept them (which they have as we have an invoice).
When people pointed this out they don't reply or contact people back. That is part of the issue.

So it's turning more into when is a sale final/accepted and how far companies can hide behind open T&Cs and not have checks in place for "errors"
In the past there have been companies that just cancel orders and not talk to customers about it yet seem to repeat errors thinking nothing of just cancelling orders if something is not right during sales etc

I don't support businesses that offend me. HN offends me.

Hi heard of several of these 300 odd people buying multiples. One woman buying 10 Dining suites hopping to sell the others for large profits. There are 2 sides to all stories. About time the media starting some even biased retorting.

I have not heard of that 1 woman however you are correct there were a few that did buy "a lot" some for friends/family etc. I can not say if it's really for friends/family or if it will end up on trademe however.

gzt: It is a truly ironic fact that advertisers rely on consumers making irrational decisions. : )

But for the majority of these cases I think they will lose in nz law and $100 is more than fair. Ooth a court might be just as annoyed at the advertising and cost HN small but just enough to cause a lot more care to be taken in the future.

There is zero chance they would lose a court battle, but defending it would cost them something.

Rikkitic: I have restrained myself up to now, but I have to say this: Every other day Harvey Norman starts screaming at maximum volume that they are having a one-time only never to be repeated end of the world sale with prices so low the store owners' children will have to be sold into slavery. So how is a customer supposed to pick out a genuine pricing error from all this endlessly repeated hyperbolic noise? I don't blame anyone for thinking they were actually having a real sale for once and trying to grab a bargain. If HN ever stopped shouting so much, people might start to take them more seriously and then someone might say hey, this can't be right, HN wouldn't do something that crazy, it must be a mistake. That company deserves everything they get and I hope the lawsuits are plentiful and successful. My ears will welcome the silence.

I'm sorry but no rational person thinks that a couch that sells every day for 3k+ is going to be sold for < $500

Ahem

1) biggest ever sale

2) no mention of normal price

3) website looks legit

4) click and bought it

More like:

1) Biggest sale ever
2) You KNOW what this means, you aren't new to NZ
3) You saw a deal on the HN Website, or more likely saw people talking about it on facebook/twitter, knew it wasn't legit, but thought you didn't have anything to lose, decided to try your luck.
4) Weren't surprised given 3) but still seem strangely upset, that they wouldn't take a $3000 loss to apease you, even though you knew it was a mistake before you bought it, because you are intelligent enough to write a post in a technical forum.

This thread has gone on about 9 pages too long. Take your $100 and move on.

That is what I first thought, but there may be some edge cases. This article quotes a couple of lawyers:

http://i.stuff.co.nz/business/72635668/harvey-norman-offers-voucher-and-apology-over-sale-and-email-bungle

There is enough uncertainty and while it is a small chance I think someone will give it a go. From the article it looks if you bought a suite for $1.5k that was normally $3k then you might have a good chance at that. Slightly different story for buying 4k for 100 but still a small chance I think.

Really nice of HN to put all potential litigants in touch. Surely that is what sparked this and kept it running for so long. Some lawyer might take it up almost pro bono just for the publicity.

I have no problems with whatever outcome.

However I wrote facts and you wrote opinions. {yes this is my opinion of course}

Haha, I know for a fact that Harvey Normal staff read these forums, I had a rant on here a while ago and was contacted (by phone) by Harvey Norman to discuss the issue I had and resolve it for me.

They know for a fact that there were people here that were "giving it a go" and this could have even been one of the sources that alerted them to the error!

Regardless as stated in the beginning, and many time over a few on here decided to "give it a go" got a $100 voucher for their efforts and will move on, to me it seems like the ones that actually have nothing to directly do with the situation are making the most noise here!

At the end of the day what has happened has happened, there is enough evidence in this thread alone to show that the consumers in this situation did not in fact act in good faith and were in fact trying it on.

And especially since JB HiFi have still never said it was a mistake. They simply cancelled orders.
