TA under fire.

 

Vaccinated or not, if it was made clear he was not allowed in, no one in their right mind would show up to be humiliated.

 

I think TA boss will resign at some point.

 

My other question is how did he get a visa by the federal govt .............. !!

Good Grief. 

 

"Prime Minister Scott Morrison has left the door open for Novak Djokovic to return to the Australian Open next year despite the tennis star facing an automatic three-year ban from the country."

 

All this fuss over getting him gone, and now they will consider waiving his three-year ban. 

 

I am unsure how they could have handled this worse. They just need to stop talking now.

Any questions over next year should be batted back with "Mr Djokovic is welcome to apply for a visa next year and we will examine the application under the conditions that will be applicable at that time."

 

Boom. Job done.

Vaccination is not a visa condition, and there were no grounds to refuse his visa prior to issuance. The vaccination status declaration is made as part of a separate document filled in 72 hours prior to travel called the Australia Travel Declaration. This is a requirement of the Biosecurity Act, not the Migration Act (the Migration Act would require an act of parliament to amend it to make vaccination a visa condition, whereas the Biosecurity Act just needs the Health Minister to issue a determination, which is a temporary legislative instrument). Supplying false or incorrect information in the declaration can result in refusal at immigration clearance which results in automatic cancellation of the visa.

 

I firmly believe Novak should sue Tennis Australia for their role in this mess, as the other player who was deported is in the process of doing. Tiley was told that they wouldn't be allowed in, twice, and then told them they would. Whether that was due to maliciousness or incompetence, they must have at least some liability for the whole situation.

Yup I agree he should sue the pants off TA.

 

HOWEVER ... if he does, TA might counter by demanding proof he actually had covid. something most people find difficult to believe to be true ...

it's not like he tried to smuggle contraban or planned to work on a tourist visa ... i believe he genuinely believed TA and Vic State did a deal with the federal govt to allow him in. though he did forget that he was in Spain ...

Ultimately though, it's irrelevant. You're responsible for ensuring information you provide is correct regardless what advice you receive. The information saying that previous infection wasn't a valid reason to not be vaccinated was publicly available, and linked from the declaration - he is a seasoned traveller, and there's a bit more of a duty of care to make sure they're across the entry requirements of a country on his team who do this professionally.

 

And yeah, that ignores "forgetting" that he'd visited another country.

That depends on the rules where you test positive, but it's my understanding that the Republic of Serbia does require you to isolate for 14 days if you test positive, regardless of whether you are symptomatic or not.

Is ND actually Anti-Vaxx or Anti Vaxx Mandate? I mean, people make their own choices around health, whether it's agreed on by the majority of people. My nephew is anti THIS vaccination but has all his other ones. He disagrees with the mandate, but he isn't what I'd call generally anti-vaxx.

 

I don't agree with his stance.

It's kind of unclear. He refuses (up until the interview with Border Force officers) to explicitly say he isn't vaccinated, but he does often make statements that can be implied only to mean that he isn't (e.g. when he said he was travelling to Australia "with exemption" - an unnecessary extra statement that served only to drive home that he wasn't vaccinated, without outright saying it, because if he was vaccinated he wouldn't need an exemption from the requirements to vaccinate). However to be fair to him, I don't think I've ever seen or heard of any instance where he's explicitly told or suggested to anyone else not to vaccinate.

Right, me either, so I don't really feel it's fair to categorize him as anti-vaxx. I know a lot of people who are against vaccine mandates even though they themselves have had it. I am not one of those people.

 

Does make the ministers assertion he would be inciting public unrest of a bit of a stretch.

 

If the Government hadn't decided to make a hoopla about his visa, he would have been in and out with a minimum of fuss.

 

I feel this saga isn't over yet. I suspect there will be claiming of costs from one party to another to come.

In April 2020 he stated he was against vaccination in a Facebook live thing. He backtracked a bit but it seems pretty evident that he’s anti vax. Then there’s the gluten story. That’s worth reading.
