Reuters - Witness in Trump documents case reached deal with prosecutors

WASHINGTON, Sept 6 (Reuters) - A key witness in the case accusing former U.S. President Donald Trump of mishandling classified documents after leaving office has entered into a deal with prosecutors to provide testimony, his former attorney said in a Wednesday court filing.

The deal was reached after U.S. Special Counsel Jack Smith’s office threatened to prosecute the witness, who is the head of information technology at Trump's Mar-a-Lago Florida resort, for lying to a grand jury ...

Politico -  Trump: ‘I look forward’ to testifying in criminal cases

06 September 2023

Donald Trump said on Wednesday that if any of the four criminal probes into the former president call him to testify, he would do it.

Oh, yes, absolutely. That, I would do. ... I look forward to testifying. At trial, I’ll testify,” Trump told conservative radio host Hugh Hewitt.

"We’ll have fun on the stand with all of these people that say the Presidential Election wasn’t Rigged and Stollen (sic),” Trump wrote in a July Truth Social post. “THE TRIAL OF THE CENTURY!!!

Excellent news!  Trump will be chief witness for the prosecution.  🙂

Reuters - Witness in Trump documents case reached deal with prosecutors

Just a note: the witness, the head of IT, is a friendly witness.

He stood up to another Trump employee, refused to erase a video server contents

Note that Nixon did something similar, with "accidently" erased audio tapes. However Trump's request is Nixon request plus Kevlar armor and on steroids.

And as noted, federal crimes have no parole possible, but of course the President can pardon.

The Washington Post - Georgia prosecutors in Trump election case estimate four-month trial

06 September 2023

ATLANTA - A trial involving former president Donald Trump and 18 others accused of conspiring to overturn the 2020 presidential election in Georgia will probably take four months, once a jury is selected, and feature testimony from more than 150 witnesses, prosecutors said in court Wednesday.

Such a timeline would force Trump to spend a third of a year sitting in an Atlanta courtroom with his co-defendants, possibly while running for president and juggling three other criminal cases, including federal charges that he conspired to overturn the 2020 election to stay in power.

PROUD BOY WILL BE IN PRISON UNTIL HE IS AN ELDERLY BOY

WASHINGTON (The Borowitz Report)—After receiving a twenty-two-year sentence, a former Proud Boy acknowledged that he will be in prison until he is an Elderly Boy.

“Yes, I will eventually be an Elderly Boy,” Enrique Tarrio told reporters. “However, let’s be clear: while we Proud Boys are considering changing the name of our group, ‘Elderly Boys’ is not an option.”

Tarrio said that, because of the behavior of other former Proud Boys at their trials, “Despondent Boys,” “Weepy Boys,” and “Belatedly Remorseful Boys” were all names that the organization was considering.

“We’ve been holding focus groups, but so far there’s been no consensus,” he said. “We may have to consult Congresswoman Taylor-Greene on this. She's very creative.”

NBC News: Eyes on 2024: The 14th Amendment debate continues
...
Last month, we wrote about an effort gaining ground in multiple states to bar Trump from the ballot next year under a 14th Amendment clause that states that no one shall hold elected office who “engaged in insurrection or rebellion against the [United States].”

Well on Wednesday in Colorado, several voters filed a lawsuit seeking to actually remove Trump from the ballot under this doctrine.

On behalf of voters, Citizens for Responsibility and Ethics in Washington (CREW) and several law firms are seeking for the court to declare it “improper” and “a breach or neglect of duty” for the Secretary of State to leave Trump’s name on the ballot following his actions on and around Jan. 6, 2021.

Georgia state's Fani Williams explains the federal / state separation of powers better than I.

Jim Jordan is a Republican U.S. Congressman, Jordan is a former collegiate wrestler and college wrestling coach, from the mid-west state of Ohio. So thinking isn't a real strength.

Vanity Fair: Fani Willis All but Calls Jim Jordan a Moron in Scathing Letter About Prosecuting Trump

n a withering letter, the subtext of which was basically “You’re a f--king idiot and I can’t believe I have to take the time out of my day to deal with you,” Fulton County district attorney Fani Willis blasted House Judiciary chair Jim Jordan and his demand that she turn over all documents related to her case against Donald Trump and the 18 other people she indicted last month. If this letter doesn’t cause Jordan such embarrassment or shame that he leaves town immediately never to return, nothing will!

More or less suggesting that the Republican Congressman ought to take a remedial civics course, Willis dubbed his request for the Trump records “offensive to any notion of separation of powers that recognizes the distinct roles of the executive and legislative functions of government,” writing: “Your attempt to invoke congressional authority to intrude upon and interfere with an active criminal case in Georgia is flagrantly at odds with the Constitution ... There is absolutely no support for Congress purporting to second guess or somehow supervise an ongoing Georgia criminal investigation and prosecution. That violation of Georgia’s sovereignty is offensive and will not stand.”

Apparently operating from the assumption that the House Judiciary chair knows less about how the US government works than a third grader, she added: “As the Supreme Court has explained, ‘the Executive Branch has exclusive authority and absolute discretion to decide whether to prosecute a case.’ Congress, in contrast, is barred by precedent from using investigations for ‘law enforcement purposes.’ You have thus violated the basic constitutional rule that ‘the power to investigate must not be confused with any of the powers of law enforcement; those powers are assigned under our Constitution to the Executive and the Judiciary’.” And she didn’t stop there!

Jim Jordan tries to assist Trump in avoiding accountability; obstructs Georgia RICO prosecution

Glenn Kirschner

US Representative Jim Jordan is abusing his position and his authority by interfering and attempting to obstruct Georgia srate's District Attorney Fani Willis's RICO prosecution of Trump and 18 of his co-conspirators. As the Atlanta Journal Constitution reported, " "Willis blasts congressman's 'interference' in Fulton probe."

When someone "interferes" in an ongoing prosecution it can constitute the crime of obstruction of justice.

When some assists a defendant in an attempt to help the defendant evade conviction and punishment it can constitute the crime of accessory after the fact.

DA Willis should consider opening a grand jury investigation, presenting evidence to the grand jury of Jordan's interference in the Trump prosecution, and ask the grand jury if they believe that there is probable cause that Jordan committed one or more offenses in violation of Georgia state law.

Note that in a previous life Giuliani was a very successful lawyer, convicting many gangster of the same crime he's now accused of: organized crime and racketeering.

So in the infrequent moments when Giuliani is not drunk or sexually assaulting his workers, he knows the importance of turning minions against their mob bosses.

Trump ‘really, really upset’ by conviction of ex-White House adviser worried ex-White House adviser will become disloyal and become a rat-fink snitch

I think the 3 month delay between the conviction and sentencing is a ploy to give ex-White House adviser Peter Navarro some time to reflect on his relationship with Trump, and consider helping prosecutors.

The Guardian: Giuliani says Trump ‘really, really upset’ by conviction of ex-White House adviser

Donald Trump was “really, really upset” when he learned that his former White House adviser Peter Navarro had been convicted of contempt of Congress, according to the ex-president’s close ally Rudy Giuliani.
...
Giuliani told the Newsmax host Eric Bolling that pending criminal charges against him and Trump were “one thing” – but it was different to see “your family, your friends, the people working for you” to get in similar trouble.

“I mean, this is absurd,” Giuliani said.

Navarro served as a senior trade adviser during Trump’s presidency. Congress subpoenaed him in February 2022 to face questioning about why Trump supporters attacked the US Capitol on 6 January 2021, temporarily delaying certification of Joe Biden’s victory during the previous year’s presidential election.

A House committee investigating the attack suspected Navarro had more information about any connection between claims of voter fraud that Trump allies had pushed and the assault on the Capitol. But Navarro did not surrender any emails, reports or notes, and he refused to testify.

On Thursday, he was found guilty of two misdemeanor counts of contempt of Congress, both punishable by up to a year behind bars. Navarro’s sentencing has tentatively been scheduled for 12 January.
