The opening of Donald Trump’s first criminal trial on Monday will put to the test a defense strategy his lawyers have been honing for a year - a confrontational gambit that has angered the judge and could cost the presidential candidate dearly when it comes to a verdict.

Trump is also trying to denigrate his accusers - including New York Supreme Court Justice Juan Merchan, District Attorney Alvin Bragg, and key witnesses such as Cohen and Daniels. ...

 

In the city that made Trump famous, but where he is now deeply unpopular, his legal team is aiming as much for a mistrial as anything else, according to people familiar with the defense strategy. 

 

Criminal defense lawyers like to say that prosecutors need to convince 12 people in the jury box, but defendants only need to convince one, and that may be especially true in the Trump case.

I suspect Florida Judge Aileen Cannon will snatch Trump's victory from the jaws of justice.

CNN: Trump attorney who became a crucial witness against him has departed legal team

Evan Corcoran, an attorney for Donald Trump who became a critical witness in the classified documents case against the former president, no longer represents him, CNN has learned.

According to multiple sources familiar with the matter, Corcoran left Trump’s legal team in recent months, a notable departure as the criminal case remains in limbo in south Florida.

Corcoran’s quiet exit from Trump’s orbit could pose a significant issue for the former president, with the potential for prosecutors to call him as a key witness if the case goes to trial. He also was one of the last attorneys on Trump’s defense team to have handled his federal investigations from the beginning, as his legal peril skyrocketed.

Corcoran was brought on to help Trump fend off charges in the classified documents investigation, but instead turned into a central witness after Trump allegedly misled him about the whereabouts of the documents at his Mar-a-Lago club and encouraged him to lie to the Justice Department and withhold those documents.

First part is only jury selection, but it will be nice to see Donald Trump making a mandatory appearance in court as a criminal defendant.

He will sit there scowling, with his usual childish grumpy, sulky, p'd off look he puts on when he's not getting his way. Sensational - couldn't happen to a more deserving person 😀

 

I hadn't actually realised how badly behaved he was at his fraud-related court appearance last year, until I saw this story today: https://www.politico.com/news/2023/11/06/trump-civil-fraud-trial-00125515

 

On his way out of court, [Trump lawyer Chris] Kise further applauded Trump’s performance, telling reporters: “In 33 years, I’ve never had a witness testify better.”

 

How many people has this guy represented in his 33 years as a lawyer? 4? And anyway from memory Trump ended up being found guilty? So much for his "great testimony" there 🙄

 

I wonder if he's still considers his testimony in such glowing terms given that he probably hasn't been paid a cent!

I got to say I love that the first criminal case involves a porn star.

I have nothing against porn stars. From seeing video interviews about non-porn topics, porn stars seem pretty "salt of the earth."

I can't find the reference but I believe California based porn workers are more likely that the general population to be Catholic or Jewish (Orthodox, Conservative not so much Reform)

The reason I like the first criminal case involving a porn star is it was extramarital and it flies in the face of the typical Christian view of the sanctity of marriage.

It is claimed to have occurred in 2006, at a time when Donald Trump was married to Melania Trump. At the time of the alleged encounter, Melania Trump had just given birth.

It's hard to capture the American right wingers attention, but it's salacious, having undue or inappropriate interest in sexual matters.

It seems like every evangelical loves a salacious tale. Evangelicals seem to have selective amnesia about “He who is without sin among you, let him cast the first stone,” Jesus Christ, John 8:7.

Bad look for a president and a Bible salesman.

A sidenote. Trump appeared in soft-porn in 2000. His cameo consists of breaking a bottle of champagne on a Playboy-branded limo while several of the playmates are visiting New York City. His one line: “Beauty is beauty, and let’s see what happens with New York.”

I'll focus on the defense layer, not the prosecutor. The judge can override a juror being rejected.

In a New York criminal trial, lawyers have the opportunity to question the jurors, a process known as voir dire.

During this process, they can object to and seek to remove some of the jurors.

However, if a defense lawyer were to reject all jurors in the pool, it could potentially harm Trump’s case.

The remaining jurors might resent the attorney for making a for-cause challenge, and the judge may even refuse to excuse the juror if he or she is not persuaded that cause exists.

Trump defender lawyer wanted to include the question "Do you like Trump?"

I guess it fits Trump's insecurities, similar to a 11 year old girl.

The question was rejected.

He is not happy being treated like every other human in society. That post first day rant and attack on the judge is, well no words . Does he not realise this is the guy who decides whether you go behind bars or are in house arrest (should he lose)?

 

Lets not forget this is not just Miss Daniels, I think a lot of people in the public seem to forget or do not realise this is not one case of "hush money" but McDougl as well. 

 

My impression listening to a very experienced Fed Prosector (my brain fog evades on his name, so take with a tiny grain of salt) he was essentially saying the law states its not just who physically pays the money but also person/people involved in requesting it to occur. Of course its an opinion but it sounded pretty compelling. But whilst he was stating that, he was not in favour of Don sitting behind bars and rather to be put under house arrest
