The NY Times - Opinion - The Dismissal of the Trump Classified Documents Case Is Deeply Dangerous

July 15, 2024

Judge Aileen Cannon’s decision to throw out serious national-security criminal charges in the classified documents case against Donald Trump is legally unsupported, ignores decades of precedent and is deeply dangerous. ...

Her decision is quite unlikely to survive the tests of time, or even the appeal Mr. Smith’s office said he intends to make. But it will further delay a case that has moved so slowly under her direction that it was already virtually certain it would never go to a jury before Election Day.

Judge Cannon asserts that no law of Congress authorizes the special counsel. That is palpably false. The special counsel regulations were drafted under specific congressional laws authorizing them. *

Eight separate judges have already rejected the claim that Judge Cannon has now endorsed. ...

*  The author, Neal K. Katyal, is a professor at Georgetown University Law Center. He was an acting solicitor general in the Obama administration.

👉  He drafted the special counsel regulations for the Justice Department in 1999 when he worked at the department.  👈

"the buck stops here" unless things go wrong, then it's someone else's fault.

Yahoo: ABC Exclusive: Trump rally shooting 'unacceptable,' Secret Service director says
...
"The buck stops with me," she said. "I am the director of the Secret Service, and I need to make sure that we are performing a review and that we are giving resources to our personnel as necessary."
...
"In this particular instance, we did share support for that particular site and that the Secret Service was responsible for the inner perimeter," Cheatle said. "And then we sought assistance from our local counterparts for the outer perimeter. There was local police in that building -- there was local police in the area that were responsible for the outer perimeter of the building."

@TeaLeaf:

Last I looked NZ had slipped from 2nd to 3rd most corrupt country in the world. The USA was 32nd.

Don't you mean NZ slipped from 2nd to 3rd LEAST corrupt country worldwide?

rofl, yes, brain fog. I was actually surprised looking at the list. The US is going to steadily slip down that list in an authoritarian state and "donations" to judges undeclared being par for course (this could be dealt with by Trump, stopping any investigation)

Im trying to get my head around how much evidence Trumps lawyers will try to argue was covered by now presidential immunity, aside from Miss Hicks, which really had little impact on the case one way or the other.

a Federal judge last year has already ruled the cheques paid in 17 after he took office weren't part of Trumps official duties. So Cohens testimony should stand.

either way most articles Ive read have stated "most" experts agree it is unlikely the case will be over turned.

If it does hold, then Trumps sentencing could have a major impact on the presidency race, especially if Jailed.

as well as Jack Smith lining up almost mock trial style lineup of testimony and evidence for judge Chutkan to decide what evidence can be used. Its likely this case could go on for years under appeal to his besties in SCOTUS, however the Media is going to be all over this one and the reporting of the evidence alone could impact the presidential race.

In the list of most democratic countries the US comes 29th and is in the group labelled 'flawed democracy'.

NZ is 2nd.

Interesting the Democracy Index is very close to the Corruption Perception I was referring to Corruption Perceptions Index - Wikipedias

It could be suggested it reinforces strong democracy governs low corruption. Is there a link to lists for during Trumps tenure? Im wondering how quickly things like "perception" change.

No doubt these SCOTUS rulings will have an impact on the next change in Perception.

For one fleeting moment I thought Trump may have turned over a new leaf, but it's clearly business as usual.

EDIT: That'd make a great little desk ornament...

No, it is a regular silver coin.

If you look at it from the outside, you might just have a different view. I already said that preparations of the Munich Security Conference are underway.

And the Herald has decided there is a "Kiwi" connection to the Vance Veep decision.....

Revealed: The Kiwi billionaire who bankrolled J.D. Vance's rise to Trump's running mate. "

TLDR. the Billionaire is Peter Thiel...

In case my "I guess you're a Batman fan (a la Two Face)" comment went over people head, Two Face would flip Morgan dollar to make a decision, with the face side scratched up. To a batman fan, Morgan dollar is
synonymous to Two-Face, like an umbrella is synonymous with the Penguin

I don't consider Peter Thiel a "Kiwi billionaire." He was born in Frankfurt, Germany. He first arrived in New Zealand at 28 years old.

Before being granted citizenship in 2011, he had spent only 12 days here.

I've lived in New Zealand for almost 30 years and got my citizenship 24 years ago. I like to think I qualify as a Kiwi.

I don't place Thiel in the same level.

I actually feel like that bloke bought his way into the country - from memory didn't John Key give him citizenship as he was planning on "investing" here? I dunno if that ever happened though.
