So there's nothing magic about being a judge or Justice.

I mean do any of you believe that there's some reason that we shouldn't have an ethics code that binds judicial officers the way we have binding ethics codes on legislative officers or executive officers?"

Courthouse News: Senator Ocasio-Cortez unveils articles of impeachment against Supreme Court Justices Thomas, Alito

Congressional Democrats on Wednesday fired their latest salvo in their battle against ethical malfeasance at the Supreme Court, as New York Representative Alexandria Ocasio-Cortez filed articles of impeachment against Justice Clarence Thomas and Justice Samuel Alito.

Though the move may prove mostly symbolic in the House, which remains in Republican control, it’s the most drastic effort yet to hold the justices to account for what Democrats and many legal experts have long said are flagrant violations of the kind of ethical conduct expected of the nation’s highest court.

“Justices Clarence Thomas and Samuel Alito’s pattern of refusal to recuse from consequential matters before the court in which they hold widely documented financial and personal entanglements constitutes a grave threat to American rule of law, the integrity of our democracy, and one of the clearest cases for which the tool of impeachment was designed,” Ocasio-Cortez wrote in a statement Wednesday.

Both justices have come under scrutiny over the past year or so amid reports that they both failed to disclose gifts and travel paid for by wealthy conservative benefactors including billionaire real estate magnate Harlan Crow and Federalist Society founder Leonard Leo.

Thomas and Alito have also resisted calls from lawmakers to recuse themselves from cases involving the 2020 presidential election and the Jan. 6, 2021, Capitol riot.

In articles of impeachment against Thomas, Ocasio-Cortez argued that the justice’s failure to report gifts and hospitality from Crow undermined the impartiality and integrity of the Supreme Court.

This comes from the Senate, but is separate from the Supreme Court impeachment proceedings against two judges. this one's around Clarence Thomas alone. It's ethics (again) plus an additional look at his taxes.

It's always bad news when the US tax authority, the IRS, get involved. Much, much worse than the NZ IRD tax authorities.

I wonder if the Supreme Court Justice can stay out of jail on tax charges.

Regarding the special counsel, you'll remember Clarence has tried to rule that all special counsels are illegal, which would help Trump in Florida's felony case (Jack Smith), but probably more importantly, help himself.

The US attorney general should appoint a special counsel to investigate potential criminal violations of federal ethics and tax laws by the supreme court justice Clarence Thomas, two Democratic senators have said.

Thomas has been at the center of an ongoing scandal over undeclared gifts, many from the rightwing mega-donor Harlan Crow, which have included flights, vacations, school fees and a property purchase.

Sheldon Whitehouse of Rhode Island, a member of the judiciary committee, and Ron Wyden of Oregon, chair of the Senate finance committee, released a letter to the attorney general, Merrick Garland, on Monday citing “evidence of repeated and willful omissions of gifts and income from Justice Thomas’s financial disclosure reports” which, they said, were required by the Ethics in Government Act.

They said the scale of Thomas’s potential ethics violations and the “willful pattern of disregard for ethics laws” more than met the level generally required by the Department of Justice to investigate.

Regarding Supreme Court Justice Clarence Thomas more revelations of unreported gifts from a billionaire.

Clarence got a NZD $456,000 loan from a billionaire for an RV, Recreational Vehicle. He only
  • paid interest only
  • never made a payment on the principal
  • Clarence never reported any of this to anyone
  • Most importantly, he never reported any of this to the IRS
Soon after getting the "loan" the billionaire "forgave" it
  • Clarence got the principal $456,000 for free
  • he no longer had to pay the small interest payments
Clarence only reported the "loan" when the press somehow uncovered this high-value gift.

A big no-no not reporting to at least the IRS.

The Washington Post - New York judge throws out Rudy Giuliani’s bankruptcy case

A federal judge in New York on Friday threw out Rudy Giuliani’s bankruptcy case, paving the way for a litany of creditors, including two former Georgia election workers who won a $148 million defamation claim against him, to pursue and potentially seize his assets.

 

The decision by U.S. Bankruptcy Judge Sean Lane in the Southern District of New York comes nearly seven months after Giuliani sought bankruptcy protection after he was ordered to immediately pay millions in damages to two Georgia women he falsely accused of helping to steal the 2020 presidential election.

 

In his 22-page order, Lane cited Giuliani’s “continued failure to meet his reporting obligations and provide the financial transparency required of a debtor in possession” and called his behavior “troubling.” 

 

It restricts Giuliani from seeking bankruptcy protection for one year.

The most important takeaway from the Supreme Court’s decision in Trump v. United States is that Chief Justice John Roberts, with the approval of his Republican colleagues, rewrote the Constitution to place the president above the law.

 

The chief justice erased the Constitution’s clear contemplation of criminal charges for presidential misconduct. 

 

He conjured, out of thin air, a distinction between “official” and “unofficial” acts that can’t survive the slightest scrutiny. 

 

He cloaked the executive in a prosecutorial immunity so complete that it shields almost any act a president might take from legal accountability as long as that president could tie it to a “core” duty. 

 

He eliminated, in practice, any distinction between a lawful or unlawful exercise of presidential authority. 

 

And Roberts did this, he says, to preserve the separation of powers and the integrity of the executive branch. ...

 


Roberts and the Trump court are arrogant enough to think that they’ve settled the issue “for the ages.”

Trust me, you don't want to be any American where your bankruptcy case fails.

They can literally start seizing properties, even houses, the next day. Any house contents will go into storage, and getting to that will be heavily monitored. He ain't going to be able grab much.

Again the US system for seizure of property is brutal. Miss a single car payment, and it's permitted to repossess the next day. (This doesn't often happen, as the company would rather not have the hassle of selling a repossessed item)

But hey, I'm sure as governor Giuliani, he didn't have a problem kicking people out of their house or repo'ing the car they were living in.
