Accessing Aussie super under financial hardship and or illness from NZ?

Does anyone know if this is possible?

Basically you can get up to $10k if you are applicable.

In their wording, it states have been on a "Crown" benefit of 26 weeks +.

Then their is hardship due to medical which is basically pleading to the Government.

Have a mate who needs money bad who has been on sickness or whatever they call it now days for nearly 2 years. Exhausted $250k of his life before they would even pay. Which I think is Assett prejudice. If he stuck it in a house they will pay immediately. Yeah as if it takes so long to sell a house even a down turning market in NZ.

Hang on he was off work and used 125k each year for the last 2 years from his savings?

He needs to control the spending and downgrade as 10k from AU is not going to help him if he is using 10k a month to live.

Also you might need to make sure "crown" also counts NZ government and not just the AU government. I don't see AU helping out much if they can't even support NZ's over in AU

Yes Crown is very shady sounding for kiwis in NZ, we dont use that word do we for government departments?

Poor bugga needs a break, no fault his own, paid his taxes, has nothing now but a few hundy a week.

Dont ever get sick in NZ you are SCREWED. At least if you are in Aussie you can access your super and better quality benefit plus health insurance included in your taxes covering faster better quality care.

But that dont do him no good, he aint going anywhere now.

If you are a kiwi in AU and get sick you get no help at all anymore. After the change in 2001 (or around that time) NZ'ers can't get any help in AU if they moved over there after the law changed but still expected to pay tax to the AU government.

If he has kiwisaver he might be able access that but it needs to be on hardship grounds on a case by case basis. It's a bit late for him now but that is why insurance companies also offer income protection etc.

If he has a super balance and not going back to work in AU then he should be able to apply to have it transferred over to his kiwisaver in NZ. There are a number of banks that have websites setup to help (google search show kiwibank, asb etc).

Private health insurance is not included in your taxes. In fact if you don't have private health insurance and earn more than $90k for individuals or $180k for couples, you are taxed more (the medicare surcharge). In addition, non protected Kiwis living in Australia pay the NDIS levy (0.5% of your income), but cannot claim on it. It must be the only insurance scheme in the world where you pay the premiums, but can never make a claim.

As for your original question, call your Kiwisaver provider. They will be able to give you definitive answer on the eligibility to claim the Australian portion of your super for the purpose you need. There are different rules for accessing the Australian portion than the NZ earned portion.

That's not true. All NZ citizens residing in Australia are eligible for medicare, public hospital services, and government rebates on private health insurance, regardless of if they are protected or non protected SCV holders.

On another note, i don't disagree with the levy for medical cover if you don't have private health insurance when earning over those amounts. People will hate me but would not mind seeing that in NZ (I have private health insurance).

Actually, all that stuff is out the window. The government changed the law so that instead of Department of Human Services (Medicare) decides whether you can release your super, the Commissioner of Taxation does. The old rules no longer apply (notably that 26 week rule).

Importantly, the new rules not only allow withdrawal on compassionate grounds outside Australia, they even tell you how to apply.
