Hello there:

I am in a bit of a situation, my past employer owes me quite a bit of money and has not yet paid it, he has held back this money until I do something for him, of which I have done.

It's been 2 weeks since he's asked me to do this for him, I did it on the day (since I had due bills, and had to pay Rent) - but 2 weeks later he has not paid me anything at all. I have left this job so am asking what's my next course of action?

I really want this resolved asap or quicker, he owes me quite a large sum of money and has not even paid me my normal pay. There's no where in the contract that states he can do this, and it seems he's just making up excuses to not pay me.

Talking to other employees that have left on about the same time he has not paid them anything either.

Gather as much evidence as possible and I'm sure you will get what's owed to you after contacting the Dept of Labour.

Serve him with a statutory demand showing the total amount owed and a breakdown of that amount (i.e. hours worked and holiday pay owed). State that you understand that employer deductions will be taken from this amount, and ensure that you get a final payslip because if he's as dodgy as he sounds then he may not calculate the employer deductions correctly which will leave you with a mess to tidy up at the end of the tax year.

Give a deadline for payment, and make sure that you immediately arrange action through the employment court if that deadline passes.

Make sure that all correspondence is in writing and it would probably pay to send by two mediums (e.g. post and email) so that he can't argue that he hasn't received it. This will help you if and when you get to the employment court.

Sounds like my old boss he was bad for paying staff he had to pay me cause i worked in the same room as him so he couldn't avoid it. But others that work away and relied on pay going into their bank account each week had a hell of a time getting it. He took over the business and made major changes In the end 3 experience workers resigned. I left not long after i just didn't want to belong to a business that was getting a bad name even locally.  Had to answer the phone for him at times while he was away and all i would get is  callers wanting to know when will they get paid. We had a german guy on a visa work permit who waited 9 weeks before he got his pay.  Many times i would catch him reading comics online.

Working for him was a complete nightmare.

Yep that sounds like my (ex) boss Smile

I finally did get paid, I threatened legal action towards him, in the end he said to me "I need to phone your dad" weird, he hung up on me, phoned my dad who gave him a airbashing - he then rung me back saying "You will have your bloddy money tonight"

I then made a spreadsheet and did some calculations for myself with how much i should get, this way I can tell if he's just trying to rip me off but what he paid me was pretty much spot on.

He has also tried phoning me today asking about computer support, well stuff that - his numbers now on my "Send calls to voicemail" list. What he did to me could be classed as a form of bullying, he has tried airbashing me over the phone, via email etc but I just spoke to him normally each time, keeping my cool, even though I really wanted to yell at him.

Remember that you are a supplier of goods and services too. Your time is money. Don't forget that... any extra time you give him, he really owes you.

Theoretically you could send him a bill for the time you have spent of 'preparing the accounts'.

Yeah, I used to charge $25 per 15mins at work, was thinking maybe I should give him payback and charge him that outside of work :P
